🏛️ OCI Cardholder Property Rights in India

OCI (Overseas Citizen of India) cardholders — including many Indian-Americans and H1-B holders who later naturalised — have the same property rights as NRIs in India. You can purchase any number of residential and commercial properties freely.

However, OCI cardholders cannot purchase agricultural land, farmhouse properties, or plantation land in India without prior RBI approval. This same restriction applies to NRIs.

Inherited agricultural land is permitted to hold and can be sold, but additional agricultural land cannot be purchased. Our lawyers advise comprehensively on all OCI-specific property rights and restrictions.

📋 Power of Attorney for US NRIs — Two Routes

Route 1 — Indian Consulate: Execute the PoA at an Indian Consulate in New York, Chicago, Houston, San Francisco, or Atlanta. This document is directly valid in all Indian courts and registration offices — no further authentication needed.

Route 2 — US Notary + State Apostille: Execute the PoA before a US Notary Public, then get it apostilled by your State Secretary of State (each US state issues its own apostille under the Hague Convention). This is equally valid in India and often more convenient for those far from a Consulate.

💵 FATCA, FBAR & Indian Property for US NRIs

Indian real estate (immovable property) is not reportable under FBAR or FATCA. However, your Indian NRE/NRO bank accounts used for property transactions may trigger FBAR reporting if combined foreign account balances exceed USD 10,000 at any point during the year.

Capital gains and rental income from Indian property must be reported on your US federal tax return (Schedule D and Schedule E respectively). The India–USA DTAA provides a foreign tax credit for taxes paid in India.
