The Insurance Regulatory and Development Authority of India (IRDAI) has issued consolidated Master Guidelines on Anti-Money Laundering and Counter Financing of Terrorism (AML/CFT), 2022, applicable to Life, General, and Health Insurers. The guidelines mandate strict compliance with Customer Due Diligence (CDD), Know Your Customer (KYC) norms, enhanced risk categorization, ongoing monitoring of transactions, and reporting obligations to FIU-IND under the Prevention of Money Laundering Act (PMLA). Insurers are required to implement robust internal controls, appoint a Designated Director and Principal Officer, maintain transaction records, and ensure compliance with statutory AML frameworks to prevent financial crimes and misuse of insurance channels.

Tax on Property Sale by NRI, TDS Provisions under Income Tax Act

The Income Tax Department has issued important clarification regarding tax on property sale by NRI (Non-Resident Indians) in India. Under Section 195 of the Income Tax Act, when an NRI sells immovable property in India, the buyer is required to deduct Tax Deducted at Source (TDS) on the sale consideration. TDS is applicable on the total sale value unless the NRI seller obtains a lower or nil deduction certificate from the Assessing Officer by filing Form 13. The buyer must ensure proper compliance to avoid penalties, interest, or future tax exposure. These provisions are particularly relevant for individuals involved in property sale NRI transactions, cross-border real estate transfers, and capital gains tax planning. Proper structuring of the transaction is essential to ensure compliance with Indian tax laws.
