What a Pune Title Check Actually Involves

Pune sits under three different planning authorities and two different land record systems, and which one applies to your property decides which documents matter. Getting that wrong is the most common reason a Pune title opinion misses something.

Property card or 7/12 extract, not both

Inside the city survey limits of Pune and Pimpri Chinchwad, urban land is recorded on a Property Card issued by the City Survey Office. Outside those limits, and for land that has not been through city survey, ownership sits on the 7/12 extract, the Satbara Utara, maintained at the talathi office. A seller who hands you a 7/12 for a flat in Kothrud is handing you the wrong document, and the reverse is equally common on plots near Wagholi and Hinjawadi.

Mahabhulekh and IGR Maharashtra are separate records

Mahabhulekh carries the revenue record, which is who the state believes owns the land. IGR Maharashtra carries the registration record, which is what has actually been registered as sold, mortgaged or gifted. A property can look clean on one and carry an encumbrance on the other. We pull both, plus Index II for every transfer in the chain, rather than relying on whichever one the seller produces.

Non-agricultural conversion

Land around Pune is frequently sold while still classified agricultural. Without a valid NA order under the Maharashtra Land Revenue Code 1966, construction on it is unauthorised, and a bank will usually decline the loan at sanction stage. We check the NA order number against the collectorate record rather than accepting a copy.

Gunthewari and unauthorised layouts

Plots subdivided below the permissible limit were regularised in parts of Pune under the Maharashtra Gunthewari Developments Act 2001. A Gunthewari-regularised plot is legal but is not the same as an originally sanctioned layout, and the difference shows up in loan eligibility, redevelopment potential and resale price.

Which authority sanctioned the plan

A plan sanctioned by the Pune Municipal Corporation, by Pimpri Chinchwad Municipal Corporation, or by PMRDA carries different conditions and different compliance histories. Several disputes we handle start with a buyer assuming PMC approval on a property that actually falls in PMRDA jurisdiction.

MahaRERA registration and the project record

For any ongoing project, the MahaRERA registration number is checked against the authority's own portal, along with the declared completion date, the quarterly progress filings and any complaints already decided against the promoter. A promoter with three adverse orders is a materially different risk from one with none.

Where Pune Property Transactions Go Wrong

The mutation entry never followed the sale

A sale is registered, but the mutation entry at the talathi or city survey office is never updated. Years later the revenue record still shows the previous owner, and the current owner cannot mortgage or sell cleanly.

Buying in a project on land with an unresolved tenancy

Old tenancy rights under the Bombay Tenancy and Agricultural Lands Act 1948 survive on some parcels around Pune. A tenant's protected status does not disappear because the land changed hands.

Society share certificate does not match the sale deed

The flat is bought, but the society transfers the share certificate to a different name or not at all. That gap blocks both loans and resale until it is corrected, often requiring a direction from the Deputy Registrar.

The builder collected for amenities never delivered

Amounts collected for amenities and facilities that are then not provided are recoverable, but the claim needs the sanctioned plan, the advertised brochure and the agreement read together before it is filed.

Agricultural land sold to a non-agriculturist

Maharashtra restricts who may purchase agricultural land. A transfer to a person who is not an agriculturist can be challenged, and the buyer carries that risk long after registration.

For a flat inside Pune or Pimpri Chinchwad city survey limits you need the Property Card, not the 7/12 extract. The 7/12 applies to land outside city survey limits and to agricultural holdings. A seller offering the wrong one usually signals the record has not been updated.

How long does a property title search take in Pune?

A standard search covering the chain of title, encumbrance certificate, property card or 7/12 and mutation entries takes about seven to fifteen working days. Properties with many transfers, an agricultural history or a Gunthewari regularisation take longer because more offices have to be searched.

Can I file a MahaRERA complaint if my Pune builder has delayed possession?

Yes. A complaint can be filed before MahaRERA for delayed possession, seeking either interest for the delay or refund with interest. The agreement for sale, the payment receipts and the registered completion date declared on the MahaRERA portal are the core documents.

What is Gunthewari regularisation and does it affect my purchase?

Gunthewari regularises plots that were subdivided below the permitted limit, under the Maharashtra Gunthewari Developments Act 2001. A regularised plot is lawful, but it is not the same as a sanctioned layout and it can affect loan eligibility, permissible construction and future redevelopment.

My Pune society has no conveyance from the builder. What can we do?

The society can apply for deemed conveyance before the Competent Authority under the Maharashtra Ownership Flats Act. The application needs the chain of title, the registered agreements of the members and proof that the promoter was called upon to convey and did not.

Is PMRDA approval the same as PMC approval?

No. Pune Municipal Corporation, Pimpri Chinchwad Municipal Corporation and PMRDA are separate sanctioning authorities with different jurisdictions and different conditions. Which one sanctioned your building affects compliance, completion certificate eligibility and what can lawfully be built on the plot.

Can an NRI buy property in Pune without travelling to India?

Yes, through a power of attorney executed abroad, attested at the Indian mission or apostilled, and then adjudicated and stamped in Maharashtra before use. We prepare it to the standard the sub-registrar will accept before you sign, which avoids the rejection that delays most NRI purchases.

What happens if the mutation entry was never updated after a sale?

The revenue record continues to show the earlier owner, which blocks mortgage and clean resale. The correction is made by applying to the talathi or city survey office with the registered deed, and by appeal to the Sub Divisional Officer if the entry is disputed or refused.
