What documents are required for redevelopment of society: title
- Conveyance deed in the society's favour, or a deemed conveyance order under Section 11 of the Maharashtra Ownership Flats Act.
- Property card or 7/12 extract showing the society or the landowner.
- Society registration certificate and bye-laws.
- Original approved plans and occupancy certificate of the existing building.
- List of members with share certificates.
Decisions and approvals
- Structural audit report showing the building's condition.
- General body resolution to consider redevelopment.
- Appointment of an architect or project management consultant.
- Tender documents and bids from developers.
- Special general body meeting resolution selecting the developer, approved by at least 51% of members under the 2019 directions, in the presence of the Registrar's authorised officer.
Is PMC mandatory for redevelopment?
The 2019 directions require the society to appoint a qualified consultant to prepare the project report and tender. Using one protects members, because the developer's offer is compared against an independent assessment of what the land can support.
Agreements that protect members
- Development agreement between the society and developer, registered.
- Power of attorney to the developer, limited to the project.
- Permanent alternate accommodation agreement (PAAA) with each member, registered, fixing the new flat's area, floor and amenities.
- Security from the developer, in the form the agreement fixes; a society should not accept a project without a bank guarantee or similar security.
Is a PAAA mandatory?
It is the member's own contract with the developer. Without a registered PAAA, a member's rights to the new flat depend only on the society's agreement, which is riskier. Every member should insist on one.
