NRI divorce lawyer for Indians living in Australia

VIVS Legal acts as an NRI divorce lawyer for Australia-based Indians whose marriage, spouse or property is still tied to India. From our office in Sanpada, Navi Mumbai, we run the Indian divorce by video and Power of Attorney, check whether an Australian divorce will hold here, and deal with maintenance, custody and the flat back home.

If you searched for an Indian divorce lawyer in Australia, note that we are Indian advocates, not Australian ones. Property orders and parenting arrangements under Australia's Family Law Act 1975 need a lawyer licensed there, and we will say so when your question crosses that line.

What we handle as NRI divorce lawyers for Indians in Australia

Clients in Sydney, Melbourne, Brisbane, Perth and Adelaide usually come to us with one of these problems:

  • A divorce in India while living in Australia, by mutual consent or contested, under the Hindu Marriage Act 1955 or the Special Marriage Act 1954.
  • An Australian divorce that India may not accept, and the steps to settle your status here before you remarry or sell property.
  • A maintenance claim filed by a spouse in India, where the court wants your Australian income proved.
  • A child taken to India, or kept here after a holiday, with no treaty route back.
  • A flat or plot in India owned jointly, which has to be transferred or sold as part of the settlement.
  • A cruelty complaint under Sections 85 and 86 of the Bharatiya Nyaya Sanhita (earlier Section 498A IPC), which needs an answer before you fly in.

Should you divorce in India or in Australia?

Often both are open. Australia has one ground, irretrievable breakdown, shown by twelve months' separation, and applications go to the Federal Circuit and Family Court of Australia. You can usually apply there though you married in India, if one of you meets Australia's citizenship, domicile or residence test; an Australian family lawyer will confirm it. In India, you can file for mutual consent after a year apart, or a contested petition on a ground in Section 13 of the Hindu Marriage Act.

Ask yourselfWhy it matters
Will India accept the divorce?A sole Australian application your spouse in India never answered is the decree most often challenged here. A joint application, or an Indian decree, is on much safer ground.
Where is the property?Title to a flat in India moves only by an Indian decree or a registered deed, whatever an Australian order says.
Where do the children live?Indian courts decide custody of a child ordinarily living in India and do not enforce Australian parenting orders automatically.
How soon do you need it?Australia needs twelve months' separation before you apply. An Indian mutual consent divorce also needs a year apart, but with the six-month wait waived it can finish within a few months of filing.

Can you finish an Indian divorce without flying back?

For a mutual consent divorce, often yes. For a contested one, plan on giving your own evidence, by video if the court allows it.

Mutual consent under Section 13B is the route most Australia-based clients take. Both spouses sign the petition and the consent terms, and each spouse's statement is recorded at the first and second motions. In Amardeep Singh v Harveen Kaur (2017) the Supreme Court said courts may use video conferencing for this. It also said a close relative such as a parent or sibling may represent a party who cannot attend for a genuine reason.

Many family courts now record a statement by video from abroad. Some still ask for one personal appearance, so book flights only after the court has said so.

A contested case is harder to run from Melbourne or Perth. Your relative in India can file papers and attend routine dates under a Power of Attorney, but cannot give evidence about your marriage. In Janki Vashdeo Bhojwani v IndusInd Bank (2005) the Supreme Court held that an attorney holder cannot depose to facts within the party's personal knowledge.

One more check before any trip: if a criminal complaint is pending against you in India, a Look-Out Circular can stop you at the airport. Find out the case status and take advice on anticipatory bail under Section 482 of the Bharatiya Nagarik Suraksha Sanhita (earlier Section 438 CrPC) before you book.

Documents and the DFAT apostille route

What to send us from Australia

  • Marriage certificate, or wedding photographs and the invitation if it was never registered
  • Passports, Australian visa, residence or citizenship papers, and any OCI card
  • Any Australian application, order or divorce certificate
  • Something that dates your separation
  • Payslips, ATO notices of assessment and bank statements
  • Title papers for any property in India
  • Children's passports and school records

Power of attorney from Australia to India

A Power of Attorney lets a parent, sibling or friend in India sign papers, collect certified copies and attend routine dates for you. You can sign it in Australia in one of two ways.

  1. At an Indian mission. Before the consular officer at the High Commission of India in Canberra or a Consulate General of India, such as Sydney, Melbourne or Perth. Check the mission's website for the current list of posts, appointment rules and whether attestation runs through an outsourced service centre.
  2. Notary and apostille. Before an Australian notary public, followed by an apostille from the Department of Foreign Affairs and Trade (DFAT). Both countries belong to the Hague Apostille Convention, so India accepts the apostille without further legalisation. DFAT generally does not apostille a document witnessed only by a Justice of the Peace, so use a notary and check DFAT's current requirements.

When the original reaches India it must be stamped under the stamp law of the state where it will be used, within three months of first arriving here. Only then should it go to court or a registry. We send the draft, mark where to sign and arrange the stamping. A separate Power of Attorney to manage or sell property here can be prepared through our Power of Attorney drafting service, from Rs 7,500.

Filing from Australia, step by step

  1. Pick the forum. India or Australia, decided with recognition, property and the children in mind.
  2. Fix the Indian court. Under Section 19 of the Hindu Marriage Act you can file where the marriage was solemnised, where you last lived together in India, or where your spouse now lives. If you both live in Australia, that usually means the place of marriage or of your last home together in India. A wife living in India can also file where she lives.
  3. Agree the terms. For mutual consent: alimony, stridhan, the children, any property and the withdrawal of other cases, in one signed settlement.
  4. Sign the Power of Attorney at a mission, or before a notary with a DFAT apostille, and courier the original to India for stamping.
  5. File and record the first statements. The spouse in Australia joins by video where the court allows it.
  6. Waiver or second motion. If the Amardeep Singh conditions are met, apply to waive the six-month gap; otherwise the second motion follows after six months.
  7. Decree and certified copy. Collect the certified copy. If an Australian authority needs it, ask them in advance what certification they will accept.

Our guide to divorce laws for NRI couples explains which personal law, and so which grounds, apply to your marriage.

Is an Australian divorce valid in India?

Not automatically. An Indian court tests a foreign divorce under Section 13 of the Code of Civil Procedure, as the Supreme Court explained in Y. Narasimha Rao v Y. Venkata Lakshmi (1991). The divorce should rest on a ground available under the Indian law of your marriage. And the other spouse should have taken part and contested on that ground, or consented to the divorce.

Irretrievable breakdown is not a ground an Indian family court can apply. Only the Supreme Court can dissolve a marriage for that reason, under Article 142 of the Constitution, as the Constitution Bench confirmed in Shilpa Sailesh v Varun Sreenivasan (2023). So the Australian divorce most at risk here is a sole application that your spouse in India never answered.

If you already hold an Australian divorce order, there are two safe ways to settle its status in India. One is a declaration of matrimonial status from an Indian family court under Section 7 of the Family Courts Act 1984. The other, if your spouse agrees, is a fresh mutual consent divorce in India. Do not remarry on an untested decree: if Indian law treats the first marriage as subsisting, you risk a bigamy charge under Section 82 of the Bharatiya Nyaya Sanhita (earlier Section 494 IPC).

Australian parenting orders and a child in India

Australia is a party to the Hague Convention on international child abduction; India is not. If a child is taken from Australia to India, or kept here after a holiday, there is no treaty route for return. The parent in Australia has to come to an Indian court, usually by a habeas corpus petition in the High Court or a custody application before the family court.

In Nithya Anand Raghavan v State (NCT of Delhi) (2017) the Supreme Court held that Indian courts decide these cases on the child's welfare, not simply because a foreign court has ordered return. An Australian order weighs heavily but does not bind. Speed matters, because the longer a child settles in India, the harder return becomes.

Flats, land and FEMA

An Australian court can make orders between the two of you about Indian property, but those orders do not by themselves change title here. A share usually moves by a registered release or gift deed, or under an Indian decree. Under the FEMA Non-Debt Instruments Rules 2019, an NRI or OCI spouse can receive a residential or commercial property this way, but not agricultural land, a farmhouse or a plantation. Our NRI property service for Australia-based clients prepares the deeds alongside the divorce.

Maintenance from Australian income

A spouse in India can claim under Sections 24 and 25 of the Hindu Marriage Act or Section 144 of the Bharatiya Nagarik Suraksha Sanhita (earlier Section 125 CrPC). Since Rajnesh v Neha (2020), both sides file a sworn affidavit of income, assets and liabilities, so your Australian payslips and ATO notices of assessment will be asked for.

How long it takes, and what changes the cost

Stage or routeUsual time
Power of Attorney signed in Australia and stamped in IndiaA few weeks, depending on appointments and courier
Mutual consent with the six-month wait waivedUsually two to three months from filing
Mutual consent with the full waitUsually seven to nine months
Contested divorceUsually two to four years at first instance

We do not quote a fee before reading your papers. The cost depends on the route you take, how many connected cases are running in India, which city the court sits in and how appearances there are handled, and whether an Australian lawyer also has to act. You get a written quote after the first consultation.

How we work with you across Australian time zones

Working with an NRI divorce lawyer in India from Australia is mostly a question of timing. Sydney, Melbourne and Canberra are four and a half hours ahead of India, five and a half during daylight saving; Brisbane stays four and a half ahead all year, and Perth is two and a half ahead. Late afternoon on the east coast is late morning in India, so most clients speak to us at the end of their working day without taking leave.

  • Consultation by video, phone or WhatsApp, with documents shared by email
  • A written note on which country to divorce in, which Indian court has jurisdiction and the likely timeline
  • Drafting of the petition, consent terms, maintenance and custody applications
  • The Power of Attorney draft and the steps to sign it in Australia
  • Advice on video appearance and on when you may need to be in India

The case is filed in the Indian court with jurisdiction, which may be in Mumbai, Navi Mumbai or another city. If it is outside Mumbai and Navi Mumbai, we explain at the first consultation how appearances will be handled and what that costs. Advice and drafting are led by Adv. Swanand Pandit, Advocate, High Court of Bombay, with Adv. Ashok Ingle handling filings and updates. Call +91 8291849797 or +91 9167710454, or email info@vivs.in.

FAQ

Frequently Asked Questions

Still have a question?

Speak with our legal team about your matter with clarity and confidence.

Australian law generally allows it if either of you is an Australian citizen, is domiciled in Australia or has lived there for the past twelve months, and you have been separated for twelve months; an Australian family lawyer will confirm the details. The harder question is whether India will accept it. A divorce your spouse joined or consented to is on much safer ground in India than one granted without them.

Not automatically. Under Y. Narasimha Rao v Y. Venkata Lakshmi (1991), an Indian court usually accepts a foreign divorce only if it rests on a ground available under the Indian law of your marriage and your spouse took part in the case or consented. A decree based only on twelve months' separation, granted without your spouse, is the one most likely to be challenged.

Not in India. Indian divorce law has no rule that marital property is split equally. Property stays with the spouse who owns it, a jointly owned flat is divided by each owner's share, and the financially weaker spouse is protected through maintenance, alimony and the return of stridhan. How an Australian court divides property is a question of Australian law, for a lawyer licensed there.

Often not. Courts can record a spouse's statement by video, and the Supreme Court has allowed representation through a close relative where a party cannot attend for a genuine reason. Practice varies between family courts, and some ask for one personal appearance. We find out what the court in your case expects before you book anything.

Usually not on its own. DFAT generally apostilles documents signed by notaries public and certain officials, not documents witnessed only by a Justice of the Peace. Sign before a notary public instead, or at an Indian mission. Check DFAT's current requirements before your appointment, because a rejected document costs weeks.

Act quickly. India is not a party to the Hague Convention on child abduction, so Australian return orders do not apply here automatically. You will usually need a habeas corpus petition in the High Court or a custody case in the family court where the child is living. Indian courts decide on the child's welfare and treat the Australian order as an important factor, not a binding one.

Nothing changes on the title until an Indian document changes it. An Australian court may make orders between the two of you about the flat, but the transfer itself needs a registered release or gift deed, or an Indian decree. Settle the flat in your consent terms and register the deed in India, so it does not become a second dispute later.

Yes. Your spouse can claim under the Hindu Marriage Act or Section 144 of the Bharatiya Nagarik Suraksha Sanhita, and you can be served in Australia. You will have to file an affidavit disclosing your Australian income and assets. Ignoring the case does not stop an order being made against you, and that order can be enforced against your assets in India.
