What an NRI divorce lawyer for UK clients handles in India

People looking for Indian divorce lawyers in the UK usually need two advisers, not one. A solicitor in England and Wales, or in Scotland or Northern Ireland, deals with the British proceedings, the financial order and arrangements for children under UK law. An advocate enrolled in India deals with the Indian personal law, the Indian court, property in India and any police case registered here.

Many UK clients already have a solicitor, and we work alongside them without advising on UK law. A London firm, for its part, cannot file your petition in an Indian family court. For the Indian half, this is what we take on:

  • A mutual consent or contested divorce petition filed in India while you live in Britain.
  • Your defence when your spouse has filed for divorce, maintenance or restitution in India.
  • An opinion on whether your UK divorce will stand in India, and what to do if it may not.
  • Custody and visitation where a child is in India or has been brought here.
  • Anticipatory bail and quashing advice if a cruelty or domestic violence case has been filed against you.
  • Release or transfer deeds that move Indian property between you after the divorce.

Can you get a divorce in India without travelling from the UK?

Often most of it, but not always all of it. Filing, routine dates and paperwork can run through a relative holding your Power of Attorney. The steps that need you personally are your consent statements in a mutual consent case and your evidence in a contested one.

In Amardeep Singh v. Harveen Kaur (2017) the Supreme Court allowed family courts to record a mutual consent case by video conferencing and to waive the six-month wait in suitable cases. Since then many family courts take a UK-based spouse's statement on a video link. Some still want to see each spouse in person once. For a contested case, Janki Vashdeo Bhojwani v. IndusInd Bank (2005) settles that a Power of Attorney holder cannot testify to matters within your personal knowledge, so your own evidence is needed, by video if the court permits.

Stage of a mutual consent caseWho must take partFrom the UK?

Second motion statementsBoth spouses, confirming consentUsually by video, if the court agrees.

We find out how the particular court handles video statements before anything is filed, so you can plan leave around a known date rather than a guess.

Documents from the UK and the FCDO apostille route

Papers to send us

  • Your marriage certificate; if the marriage was never registered, the invitation card and wedding photographs instead.
  • Passports, your UK visa, BRP or naturalisation certificate, and any OCI card.
  • Every UK court document: the application, the acknowledgment of service, and any conditional or final order.
  • Something showing when you separated, such as a tenancy agreement or council tax bill in one name.
  • Income evidence: recent payslips, your P60 and, if self-employed, SA302 tax calculations.
  • Title papers for any property in India, and children's passports and school records.

Signing in front of a UK notary

You sign the Power of Attorney and any affidavit before a notary public. The notary's signature is then apostilled by the FCDO Legalisation Office. Because the UK and India are both parties to the Hague Apostille Convention, the Indian High Commission does not need to attest the document again.

Or sign at an Indian mission

The other route is to have the document attested by a consular officer of the High Commission of India, London, or of one of its Consulates General. Which office covers your area and how appointments work changes from time to time, so check the mission's own website first.

Three mistakes we see from UK clients

  • Using a Lasting Power of Attorney. An LPA registered with the Office of the Public Guardian is an English document for English purposes. An Indian court or sub-registrar needs a separate Power of Attorney drafted for India.
  • Signing before the draft is checked. An apostille confirms the notary's signature and seal. It does not cure a wrong court name or a wrong property description inside the document.
  • Leaving the original unstamped. Indian stamp law allows three months from the day the original first reaches India. Miss that and the document can be impounded, with a penalty to pay before anyone may use it.

We draft the India-side document as part of the case. If you need one only for a property matter, the drafting service for a Power of Attorney costs from Rs 7,500.

Filing for divorce in India from the UK, step by step

  1. First consultation. You email the marriage certificate and any UK papers, and we speak by video or phone.
  2. Written note. We set out which Indian court can hear the case, which law applies, whether mutual consent is realistic, and what each step needs from you.
  3. Drafts by email. The petition, the supporting affidavit, consent terms where you have agreed them, and the Power of Attorney come to you for comment.
  4. Signing in Britain. You sign before a UK notary, obtain the FCDO apostille and courier the originals to our Sanpada office.
  5. Filing and service. We stamp the Power of Attorney, file the petition and arrange service. If your spouse also lives in the UK, formal service abroad can take months, so we ask the court to permit email and courier service as well.
  6. Hearings and decree. You give your statements or evidence, by video where allowed, we report after every date, and the certified decree is sent to you.

Under Section 19 of the Hindu Marriage Act, the petition can go to the family court where you married, where your spouse now lives, or where the two of you last lived together in India. A wife who has moved back to India can also file where she lives.

Is a UK divorce valid in India?

Not automatically. Section 13 of the Code of Civil Procedure, 1908 lets an Indian court refuse a foreign judgment that was given by a court without proper jurisdiction, not on the merits, against natural justice, or in disregard of Indian law. For divorce, the Supreme Court applied that section in Y. Narasimha Rao v. Y. Venkata Lakshmi (1991). The foreign court must have had jurisdiction on a basis Indian matrimonial law accepts, and the divorce must rest on a ground that law also recognises. The exceptions are where the respondent was permanently resident there and the ground exists in Indian law too, where the respondent contested the case on such a ground, or where the respondent consented.

The April 2022 change in England and Wales

Since 6 April 2022 the Divorce, Dissolution and Separation Act 2020 has made divorce in England and Wales no-fault. The only ground is irretrievable breakdown, shown by a statement, and the decree nisi and decree absolute became the conditional order and the final order. Indian matrimonial statutes, the Hindu Marriage Act, 1955 included, do not list irretrievable breakdown as a ground of divorce. In Shilpa Sailesh v. Varun Sreenivasan (2023) the Supreme Court held that it can dissolve a marriage on that basis under Article 142 of the Constitution; family courts have no such power.

  • Joint application. You applied together, so the consent exception applies. This is the safest UK decree to rely on in India.
  • Sole application that your spouse acknowledged and did not defend. Stronger than an ignored one, but read the form: acknowledging service is not the same as agreeing to the divorce.
  • Sole application that your spouse in India ignored. The weakest. If your spouse later challenges it, an Indian court may treat the marriage as still subsisting.

Decrees granted before April 2022 rested on facts such as adultery, behaviour or desertion, and some of these match Indian grounds. Scotland and Northern Ireland have their own divorce statutes, so for their decrees we work from the pleadings rather than a general rule. Where a UK decree is weak and its validity matters in India, for remarriage, a property transfer or a parent's estate, the usual fix is a fresh divorce in India by consent, if your former spouse will cooperate.

UK financial orders, Indian property and the FEMA and tax points

Section 44A of the Code of Civil Procedure lists the United Kingdom as a reciprocating territory. A money decree of one of the listed UK superior courts can be filed for execution in an Indian district court without a fresh suit, though the Section 13 objections remain open to the other side. Many financial orders are now made in the Family Court, which is not named in the original notification, so we check whether your particular order qualifies before you rely on it.

Land records work differently. An English court can order your spouse to transfer a flat in Pune and enforce that against them in England. But the Indian title changes only through an Indian decree or a deed registered in the sub-registrar's office for the area where the flat stands. We draft the release or transfer deed and work out the stamp duty for that state, and an attorney can present it if neither of you can travel. Our NRI property page for UK clients covers the wider property work.

  • FEMA. If you are an NRI or OCI cardholder, your spouse can transfer a residential or commercial property to you; agricultural land, farm houses and plantation property are excluded. Farmland in a settlement must stay with, or go to, a resident Indian citizen.
  • Money out of India. Alimony paid to you in India usually lands in an NRO account. Up to USD 1 million can be sent abroad from NRO balances in a financial year, with the bank's tax paperwork.
  • For your UK solicitor. Part III of the Matrimonial and Family Proceedings Act 1984 can allow financial claims in England after an overseas divorce. And enforcing an Indian maintenance order in Britain is a question of UK law.

Which Indian law governs your divorce?

The law of your marriage decides the grounds and waiting periods in India, not the country you now live in.

Children, maintenance and criminal complaints between the UK and India

Children

The UK is a party to the 1980 Hague Convention on child abduction and India is not. When a child is taken from Britain to India, the High Court in London often makes the child a ward of court and orders a return, but India does not enforce that order as of right. In Nithya Anand Raghavan v. State (NCT of Delhi) (2017), a case about a child brought from the UK, the Supreme Court held that the Indian court decides on the child's welfare and treats the English order as one factor. Act quickly: a child who has settled into school here is harder to move.

Maintenance

A spouse in India can claim maintenance under Section 24 (interim) and Section 25 (permanent) of the Hindu Marriage Act, under Section 144 of the Bharatiya Nagarik Suraksha Sanhita (earlier Section 125 CrPC), or under the Protection of Women from Domestic Violence Act, 2005. Since Rajnesh v. Neha (2020), both sides file an affidavit disclosing assets and liabilities. For a UK earner the court looks at P60s, payslips and SA302s, set against rent or mortgage and childcare costs in Britain.

Criminal complaints

A divorce filing in Britain sometimes prompts a cruelty complaint in India, now under Sections 85 and 86 of the Bharatiya Nyaya Sanhita (earlier Section 498A IPC). The usual answers are anticipatory bail under Section 482 of the Bharatiya Nagarik Suraksha Sanhita (earlier Section 438 CrPC), a quashing petition in the High Court under Section 528 BNSS (earlier Section 482 CrPC), or a negotiated settlement. Sort out your position before you book a flight to India, not after you land.

Timelines and what decides the cost

Expect roughly six to eighteen months from filing to decree when both of you agree. The Act asks for a year of living apart before you file and a six-month gap between the two motions, though the court can waive the gap where every issue is settled. Contested cases usually run for several years, and a spouse who lives in the UK adds time for service and video arrangements.

Our fee for the Indian case depends on:

  • the route, because mutual consent is far shorter than a contested trial;
  • the city of the court, and who will cover hearings when the court sits beyond Mumbai and Navi Mumbai;
  • the number of linked proceedings, for example maintenance, custody or a criminal complaint;
  • whether property in India has to be transferred as part of the settlement.

We quote in writing after reading your papers. Court fees, stamp duty, notary and FCDO charges, and courier costs are separate.

How we work with you from Navi Mumbai

India is four and a half hours ahead of the UK in British Summer Time and five and a half hours ahead in winter. Our day, 9 AM to 6 PM India time, Monday to Saturday, therefore covers the British morning, which is when most UK clients call us. Drafts and updates go by email, and quick questions by WhatsApp.

Our own court work is in Mumbai and Navi Mumbai. A case that must be filed elsewhere, say because you married in Ludhiana or your spouse lives in Ahmedabad, is planned differently, and at the first consultation we explain who will cover hearings there and what that costs. To start, send us a short note with your marriage certificate and any UK court papers.

NRI divorce help for other countries

If your spouse lives in another country, or you move, these pages cover the rules there: USA, Canada, Australia, UAE, Singapore and New Zealand. The general picture is on our NRI divorce lawyer page.

FAQ

Frequently Asked Questions

Still have a question?

Speak with our legal team about your matter with clarity and confidence.

Yes, if a UK court has jurisdiction, usually through habitual residence or domicile; your UK solicitor will confirm that on your facts. Whether India accepts the divorce is a separate question. Under the no-fault system in England and Wales, a joint application gives you the strongest position in India, and a sole application your spouse never answered gives the weakest.

Not safely, if either the remarriage or anything else in your life depends on Indian law. A no-fault decree your spouse never took part in may be treated in India as no divorce at all, which would expose a second marriage to a bigamy complaint. Get an opinion on the decree first, and where your former spouse will cooperate, consider a mutual consent divorce in India.

Yes. Living in Britain does not stop you. The family court can be the one for the city of the wedding, your spouse's present city, or the place you last shared a home in India, and a wife back in India may file in her own city. You sign before a UK notary with an FCDO apostille, and a relative holding your Power of Attorney covers routine dates.

For a marriage that took place in India, a mutual consent divorce in an Indian family court, with the six-month wait waived where everything is settled, is often the quickest decree India will accept without argument. In England and Wales a joint no-fault application cannot finish in less than about 26 weeks, and it is also the UK decree that holds up most reliably in India.

No. A Lasting Power of Attorney registered with the Office of the Public Guardian is designed for decisions in England and Wales, often about health or finances if you lose capacity. For an Indian court or sub-registrar, sign a separate Power of Attorney drafted for India, before a UK notary with an FCDO apostille or at the Indian mission, and have it stamped here within three months.

How English courts divide assets is a question for your UK solicitor. Indian law has no rule of equal division: each spouse keeps what stands in their own name, and the court awards maintenance or permanent alimony based on income, needs, the standard of living during the marriage and the length of the marriage. Jointly owned property is divided by agreement or, failing that, in a case before the family court.

A marriage solemnised before an Indian marriage officer abroad falls under the Foreign Marriage Act, 1969. Section 18 of that Act applies the matrimonial provisions of the Special Marriage Act, 1954, so mutual consent divorce is under Section 28 and contested grounds under Section 27. Where you can file in India depends on where each of you has lived here, which we check from your addresses.
