Working with a property lawyer from Thane
We do not have an office in Thane. Thane clients meet us at Office 219, Haware Intelligentia Park, Plot No. 33, Sector-24, Sanpada-Turbhe Road, Navi Mumbai 400783, about half an hour away by the Thane-Belapur Road or the trans-harbour line, or work with us entirely by video call and email.
Meetings are by appointment, Monday to Saturday, 9 AM to 6 PM. Most property files can be handled with one visit: you bring the society file or the developer's agreement once, and drafts, opinions and title reports come to you by email after that. Where a matter needs attendance at a Thane sub-registrar's office, the Co-operative Court or a civil court in Thane, we tell you at the first consultation who will attend and what it adds to the cost.
Thane property work is led by Adv. Swanand Pandit, Advocate, High Court of Bombay, with Adv. Ashok Ingle. Call +91 8291849797 or +91 9167710454 to book a time.
What does a property lawyer in Thane handle?
A property lawyer in Thane spends most of the day on three things: society redevelopment, resale flats with society transfers, and new flats bought under MahaRERA. The housing stock explains why. Older society buildings in Naupada, Panchpakhadi and much of Thane West are near the end of their life, while new towers keep going up along Ghodbunder Road, Pokhran Road, Kolshet and Balkum.
- Reading and negotiating development agreements and permanent alternate accommodation agreements for members
- Title searches and title reports before a resale purchase or a home loan
- Agreements for sale, gift and release deeds, and leave and licence agreements
- Society share transfers, nominations and disputes with the managing committee
- Deemed conveyance applications for societies that never received their land
- MahaRERA complaints for delayed possession, refunds and defects
- Civil suits on title, possession, injunctions and partition of family property
Society redevelopment in Thane: the new rules and your PAAA
Redevelopment of a Thane housing society now follows the government resolution issued by the Co-operation Department on 30 September 2026 under Section 79A of the Maharashtra Co-operative Societies Act, 1960, which replaced the 2019 directions and the circulars issued under them.
Under the new resolution, the special general meeting needs a quorum of two-thirds of the members, and both the redevelopment proposal and the developer's appointment need the written consent of at least 51 per cent of the total membership. Members who join by video conference or another approved system count towards the quorum and the majority. The meeting that picks the developer must be video recorded, and at least three tenders must be invited. The development agreement is to be signed within three months of choosing the developer, and each member's permanent alternate accommodation agreement within three months of the development agreement being registered.
The PAAA is the document that protects you
For each member, what matters most is the permanent alternate accommodation agreement (PAAA) signed with the developer. We read what it promises you in carpet area, the monthly rent while you are out and how it rises, shifting charges, any corpus payment and the date for handing over the new flat. We also check what security the society holds, what happens if work stops, and whether the rent and the new flat can pass to a buyer or an heir. Our page on documents required for redevelopment lists the society's papers in full.
Cluster redevelopment under Thane Municipal Corporation
Cluster redevelopment works differently from a society deciding to rebuild. Thane Municipal Corporation prepares urban renewal plans covering whole areas of old, dangerous and unauthorised buildings and redevelops them together. Work began in Kisan Nagar, and the first phase also covered areas such as Kopri, Rabodi, Hazuri, Lokmanya Nagar and the Tekdi Bungalow area of Panchpakhadi.
For an owner, a cluster changes three things. Eligibility for a new home is decided by survey and the scheme's rules, not by a society vote. The area you receive follows the scheme's norms rather than a negotiated PAAA. And the timing depends on the whole cluster moving, not just your building. Before you buy or sell in an area marked for a cluster, find out whether the building falls inside an urban renewal plan and what the survey recorded for that flat.
Buying a new flat in Thane: MahaRERA checks
Before booking a flat on Ghodbunder Road, Kolshet, Balkum or Majiwada, check the project on the MahaRERA portal: its registration, the promoter's disclosures, the sanctioned plan, the declared completion date and any complaints already filed against it.
Section 13 of the Real Estate (Regulation and Development) Act, 2016 stops a promoter taking more than 10 per cent of the price before a registered agreement for sale. If possession is late, Section 18 lets you withdraw with a refund and interest, or stay in the project and claim interest for every month of delay. Our page on RERA complaints and builder disputes explains how a complaint is filed and argued.
Resale flats and society transfers in Thane
Buying a resale society flat in Thane is two transfers, not one: the registered agreement for sale, and the transfer of the seller's shares and membership in the society. The society's register, not the deed alone, decides who receives notices, who votes and who is treated as the member when redevelopment begins.
- Get the dues statement from the society in writing, not from the seller.
- Read recent general body and committee minutes for anything about the flat or a redevelopment decision.
- Check whether the seller's name appears on the developer's list of members if a development agreement has been signed.
If a member and the society fall out, the Co-operative Court decides the dispute under Section 91 of the Maharashtra Co-operative Societies Act. Our note on housing society disputes in Maharashtra covers the common ones.
Deemed conveyance for older buildings
Many older Thane buildings never had the land conveyed to the society, and without conveyance a society struggles to redevelop or borrow. Under Section 11 of the Maharashtra Ownership Flats Act, 1963, the society can apply to the District Deputy Registrar of Co-operative Societies, Thane for a certificate of deemed conveyance, and then register the conveyance on the strength of that certificate.
Which office or court deals with a Thane property problem?
Most Thane property questions start at one of three places: a sub-registrar's office for documents, Thane Municipal Corporation for the building, or the co-operative department for the society.
| Issue | Where it goes |
|---|---|
| Registering agreements, deeds and leave and licence agreements | Joint Sub-Registrar offices in Thane |
| Property tax, building permission, occupancy certificate, dangerous building notices | Thane Municipal Corporation |
| Cluster eligibility and urban renewal plans | Thane Municipal Corporation, through the cluster scheme |
| Deemed conveyance and redevelopment process complaints | District Deputy Registrar of Co-operative Societies, Thane |
| Disputes between members and the society | Co-operative Court, under Section 91 |
| Title, possession, injunction, partition, specific performance | Civil courts at Thane |
| Builder delay, refund or defects | MahaRERA, or the consumer commission for Thane district |
| A licensee who will not leave | Competent Authority under Section 24 of the Maharashtra Rent Control Act, 1999 |
Before each monsoon, TMC lists dangerous buildings by category, from C1, which must be vacated and pulled down, to C3, which needs minor repairs. A C1 or C2A notice changes the timing of everything, including redevelopment, so check the current list before you sign.
Buying a flat in a Thane building due for redevelopment, step by step
- Find out the stage. Has the society passed its resolution, appointed a developer, registered the development agreement and received TMC approvals?
- Read the development agreement and the seller's PAAA. They show what the seller is entitled to and whether that entitlement can pass to you.
- Search the title. The sub-registrar's records, the property card or 7/12 extract, and a separate check for court and society disputes.
- Check TMC's records. The dangerous building category, the approvals and the property tax position.
- Draft the agreement for sale. It should transfer the seller's PAAA entitlement along with the flat and record the society's and developer's written acknowledgement.
- Pay stamp duty and register. Duty is paid online, and both sides appear at a Thane sub-registrar's office with two witnesses.
- Update the society and the developer. Get the share certificate endorsed and your name on the developer's list of members, with the rent paid to you.
The last step is the one buyers skip. Until the developer's records change, the rent and the new flat are still tied to the seller.
Documents to collect for a Thane property deal
- Every earlier agreement in the chain of title, with its Index II
- Share certificate, society dues statement and the society's no-objection letter
- Commencement and occupancy certificates from TMC
- Property card or 7/12 extract for the land
- Society resolutions, the developer's appointment letter, the registered development agreement and the member's PAAA
- Recent TMC property tax bills and receipts
- MahaRERA registration certificate and the builder's agreement, for a new flat
- Deemed conveyance certificate or conveyance deed, if the land has been conveyed
A search of the sub-registrar's records, usually going back thirty years, shows registered mortgages and transfers. Litigation needs a separate court search, because a case shows up in the registry only if a lis pendens notice was registered. Our property title search service covers both.
Stamp duty, registration and our fees for Thane property work
In the Thane Municipal Corporation area, stamp duty on a flat is usually 7 per cent: 5 per cent duty, a 1 per cent surcharge in place of local body tax and a 1 per cent metro cess. A woman buying in her own name usually gets a 1 per cent concession. Duty is charged on the higher of the agreement value and the ready reckoner value. The registration fee is 1 per cent of the value, up to Rs 30,000. Both are set by notification, so we confirm the current figures when the agreement is drafted.
How long things usually take
A resale with a clean file is usually registered two to four weeks after the title report. A deemed conveyance application usually takes a few months once the papers are complete. Redevelopment itself usually takes several years from choosing a developer to moving into the new flat, which is why the rent and delay clauses in the PAAA matter so much.
What decides our fee
Our agreement to sale with a title search report is priced from Rs 18,000. Reviewing a development agreement and PAAA depends on their length and on what has already been negotiated. A dispute depends on the forum and the stage it has reached, and we quote it in writing after reading the papers.
Mistakes to avoid with Thane property
- Buying in a building under redevelopment without reading the PAAA. You are buying an entitlement, and the agreement says what it is.
- Assuming society terms apply inside a cluster. In an urban renewal plan, the scheme's rules decide eligibility and area.
- Taking the seller's word on society dues. Get the statement from the society in writing.
- Paying more than 10 per cent before a registered agreement. Section 13 of the RERA Act forbids it for a reason.
- Skipping the society transfer. Notices, votes and redevelopment benefits keep going to the seller.
- Ignoring the dangerous building list. A C1 notice can mean vacating within days of buying.
- Treating a registry search as a litigation search. Court cases need a search of their own.

Under the Co-operation Department's resolution of 30 September 2026, the special general meeting needs a quorum of two-thirds of the members, and the redevelopment proposal and the developer's appointment each need written consent from at least 51 per cent of the total membership. Members attending by video conference count towards both figures.
In a cluster, Thane Municipal Corporation redevelops a whole area under an urban renewal plan instead of one society choosing a developer. Your eligibility depends on the survey and the scheme's rules, the area you receive follows the scheme's norms, and timing depends on the entire cluster, not your building alone.
Usually yes, but you are selling your entitlement under the PAAA and the development agreement, not just the old flat. The buyer takes over your rights to the new flat and the rent. Check whether the developer's consent is needed, and make sure the society and developer record the buyer's name.
Usually 7 per cent within the Thane Municipal Corporation area: 5 per cent duty, a 1 per cent local body surcharge and a 1 per cent metro cess, on the higher of the agreement and ready reckoner values. Women buyers usually get a 1 per cent concession. Registration adds 1 per cent, capped at Rs 30,000.
A society can insist on its dues and the forms its bye-laws require, but it cannot refuse a transfer without lawful reason. A buyer facing delay can approach the registrar's office, and a dispute between the member and the society goes to the Co-operative Court under Section 91 of the Act.
Yes, a buyer can file online without a lawyer. Legal help is useful in choosing between a refund and delay interest under Section 18, assembling the payment trail and answering the promoter's defences. If the promoter appeals to the Maharashtra Real Estate Appellate Tribunal, the drafting becomes more technical.
It applies under Section 11 of the Maharashtra Ownership Flats Act, 1963 to the District Deputy Registrar of Co-operative Societies, Thane, with its registration papers, the flat agreements and land records. If the builder never conveyed the land, the registrar can certify deemed conveyance, which the society then registers as its title.
C1 is the most serious category in Thane Municipal Corporation's pre-monsoon list of dangerous buildings. It means the building is unsafe to occupy and must be vacated and demolished. A buyer or a member should check the current category before signing anything, because a C1 notice changes both the timing and the terms of redevelopment.
