Property lawyer in Navi Mumbai for CIDCO, title and RERA matters

Need a property lawyer in Navi Mumbai? VIVS Legal checks titles, handles CIDCO transfers, mortgage permission and freehold conversion, and acts in society and MahaRERA disputes, from our office in Sanpada. Because most Navi Mumbai land is leased by CIDCO, a purchase here needs CIDCO's record checked as carefully as the seller's papers.

We have been in practice since 2010. Meet an advocate by appointment, Monday to Saturday from 9 AM to 6 PM, or consult us by phone, WhatsApp or video and send the papers by email.

Meet a property lawyer in Navi Mumbai at our Sanpada office

VIVS Legal works as a property lawyer in Navi Mumbai from our only office, at Office 219, Haware Intelligentia Park, Plot No. 33, Sector-24, Sanpada-Turbhe Road, Navi Mumbai 400783. Most of our property work here is about one question: can this flat or plot be bought, sold, mortgaged or transferred safely, given that the land under it usually belongs to CIDCO?

Being in the same city as the CIDCO estate offices, the sub-registrar offices and the Belapur courts helps in practical ways. You can bring a seller's file across in an afternoon, we can read the original lease papers rather than a blurred scan, and a deadline for a society NOC or a transfer application does not wait on travel.

We meet clients by appointment, Monday to Saturday, 9 AM to 6 PM. Send the papers ahead so they are read before the meeting. If coming in is difficult, a first review works over video with the documents sent by email to info@vivs.in. Adv. Swanand Pandit, Advocate, High Court of Bombay, leads property matters, with Adv. Ashok Ingle (B.A. LL.B) on the paperwork. We have been in practice since 2010.

Property work we do in Navi Mumbai

  • Resale purchases: reading the seller's chain of agreements, the CIDCO record and the society file before you pay a token amount.
  • New construction: checking the MahaRERA registration, the agreement for sale and the builder's title before booking.
  • CIDCO transfers: transfer applications, mortgage permission, tripartite agreements for CIDCO-built homes and freehold conversion.
  • Title search: a search of the registered records with a written report. See our property title search service.
  • Society matters: share transfers, nominations, membership refusals and deemed conveyance.
  • Builder disputes: complaints before MahaRERA for delayed possession, refunds and defects. Our RERA complaints practice covers this in more depth.
  • Leases and tenants: leave and licence agreements and eviction. See landlord and tenant disputes.
  • Family property: partition, inheritance and the transfer of a flat after a death or a divorce.

What you own on CIDCO leasehold land

In most of Navi Mumbai, you own a flat or a building's interest in a CIDCO lease, not the land outright. CIDCO, the state's planning agency for the city, leased plots to developers, housing societies and individual allottees, usually for 60 years, on conditions written into the agreement to lease and the lease deed.

Those conditions restrict change of use, extra construction and transfer without CIDCO's permission. They are the reason a Navi Mumbai purchase needs more checking than a freehold flat in many other cities. A buyer has to confirm not only that the seller owns the flat, but that every earlier sale was recorded by CIDCO and that the lease conditions were not breached along the way.

For older CIDCO-built tenements and plots, the lease passes through a tripartite agreement between CIDCO, the seller and the buyer, which is stamped and registered. For a flat in a society building, the society's share certificate and CIDCO's record have to tell the same story.

CIDCO transfer charges and the NOCs a resale needs

When a flat on CIDCO leasehold land is sold, CIDCO has to record the new holder and charges a transfer fee for doing so. The application goes to CIDCO's estate department, largely online, with the registered agreement, the society's papers and proof of the earlier chain. CIDCO sets and revises the fee, so we work from the current figure for your node and use, not an old rate card.

The most common gap we find in resale files is an earlier sale that was never transferred in CIDCO's books. Banks may hold back a loan until it is fixed, and the next buyer's lawyer will ask for it, so it is cheaper to close before you pay than after.

Expect three permissions on a typical resale:

  • the housing society's no-objection and dues certificate;
  • CIDCO's transfer approval for any earlier sale that was never recorded;
  • CIDCO's permission to mortgage, which many banks ask for on a leasehold flat.

Where no society was ever formed, the builder's no-objection takes the society's place. The agreement for sale should say who obtains each permission, who pays the CIDCO charges, and how much of the price is held back until they arrive.

Freehold conversion since 2025

Since July 2025, CIDCO has run an optional scheme to convert leasehold residential plots to freehold where a lease deed has already been executed. Once a plot is converted, CIDCO stops charging transfer fees on later transfers, which makes resale simpler and cheaper.

The conversion is not automatic and it is not free. A one-time charge applies, and plots allotted at concessional rates attract more. For a flat in a society, the question is whether the plot under the building has been converted, and who must apply depends on whose name the lease stands in, usually the society's.

Before buying, we check whether conversion has happened, has been applied for, or is still open. That changes both the paperwork and the true cost of the flat.

RERA lawyer in Navi Mumbai for new projects and delays

As a RERA lawyer in Navi Mumbai, we act for buyers in new projects across Kharghar, Ulwe, Taloja, Panvel and the nodes growing around the new airport. The first step is to look the project up on the MahaRERA website and read its registration, approved plans, declared completion date and any complaints already filed.

Under the Real Estate (Regulation and Development) Act, 2016:

  • a promoter cannot take more than 10 per cent of the price before a registered agreement for sale (Section 13);
  • a buyer may withdraw with a refund and interest, or stay and claim interest for each month of delay, if possession is late (Section 18);
  • the promoter must help form the society within three months of a majority of flats being booked (Section 11(4)(e)) and execute the conveyance (Section 17).

A complaint for delay, refund or defects goes to MahaRERA. The district consumer commission is an alternative for some disputes, and the choice between the two is worth discussing before filing, because it affects how fast an order can be enforced.

Society share transfers and deemed conveyance

In a Navi Mumbai housing society, the share certificate is how membership passes, so a flat is not fully yours until the society transfers the shares into your name. The society can ask for its forms, the registered agreement and payment of dues, but it cannot refuse a transfer without a valid reason under its bye-laws and the Maharashtra Co-operative Societies Act, 1960.

A member's dispute with the society, over a transfer, maintenance or parking, goes to the Co-operative Court under Section 91 of that Act. Read more in our guide to housing society disputes in Maharashtra.

Where a builder never conveyed the building's interest to the society, the society can apply for deemed conveyance to the District Deputy Registrar of Co-operative Societies under Section 11 of the Maharashtra Ownership Flats Act, 1963. On CIDCO land, that conveyance relates to the builder's lease rights, and CIDCO's own permissions still apply.

Which office or court handles a Navi Mumbai property matter?

It depends on what the matter is and on which side of the district line the property sits. Airoli to CBD Belapur is in Thane district under the Navi Mumbai Municipal Corporation. Kharghar, Kamothe, Kalamboli and New Panvel are in Panvel taluka of Raigad district, mostly under the Panvel Municipal Corporation.

Step by step: buying a resale flat in Navi Mumbai

  1. Collect the seller's file. Every earlier agreement with its Index II, the CIDCO allotment and transfer letters, the share certificate, the occupancy certificate, the society's dues statement and the latest tax bill.
  2. Check CIDCO's record. Confirm that each earlier sale was transferred in CIDCO's books with charges paid, and whether the plot has been converted to freehold.
  3. Run the title search. Search the registered records for at least thirty years, and look separately for court cases, society disputes and bank charges.
  4. Get the title report and NOCs. The seller obtains the society's no-objection; you apply for CIDCO's mortgage permission if you are taking a loan.
  5. Settle the agreement for sale. It fixes the price, holds back part of it against dues, and says who completes the CIDCO transfer and pays for it.
  6. Stamp and register. Stamp duty is paid online on the higher of the agreement value and the ready reckoner value. The registration fee is 1 per cent, capped at Rs 30,000. Both sides then attend the sub-registrar's office.
  7. Complete the transfers. Apply to CIDCO with the registered agreement and the fee, have the society transfer the shares, and move the tax record into your name.

Papers to bring for a Navi Mumbai property review

  • Every earlier agreement for sale, with its Index II.
  • CIDCO allotment letter, agreement to lease or lease deed, and transfer letters for each earlier sale.
  • Tripartite agreement, where the flat or plot was CIDCO-built.
  • Share certificate, and the society's no-objection and dues certificate.
  • Occupancy certificate and, for a new project, the MahaRERA registration and approved plans.
  • Latest NMMC or PMC property tax bill.
  • Loan sanction letter, if you are borrowing, and the seller's loan closure letter if the flat was mortgaged.

Copies are enough for the first review. If anything is missing, we tell you which office holds it and how to get a certified copy.

Mistakes to avoid with Navi Mumbai property

Most of the problems we are asked to fix in Navi Mumbai could have been caught before the token amount was paid. The same handful come up again and again.

  • Paying before the CIDCO record is checked. A seller can hold a registered agreement and a share certificate while CIDCO still shows an earlier owner. Until that gap is closed, a bank may refuse the loan and the next buyer will ask about it.
  • Treating a power of attorney sale as ownership. Some older flats changed hands on a power of attorney and an unregistered agreement. That does not pass title, and CIDCO will not record a transfer on it.
  • Ignoring the tax arrears. Kharghar and the Panvel nodes moved from CIDCO service charges to Panvel Municipal Corporation property tax, and some buildings carry disputed arrears. See the latest bill and make the agreement say who bears any arrears.
  • Booking a project without reading its MahaRERA page. The registration, the declared completion date and the complaints already filed tell you more about a builder than the brochure does.
  • Leaving the society transfer for later. Until the shares are in your name, you are not a member, and a dispute over dues or parking is harder to fight.

What a property lawyer in Navi Mumbai charges

The fee depends on the work, not on the price of the flat alone. A clean resale with a complete CIDCO record costs less to check than one with an untransferred earlier sale, a missing society NOC or a pending court case.

What moves the cost: how far back the chain of title runs, whether CIDCO transfers or freehold conversion have to be completed, whether a loan and mortgage permission are involved, and whether a dispute needs a notice, a complaint or a suit. We quote in writing before starting and list the government charges separately: stamp duty, registration fees and CIDCO's transfer fee.

FAQ

Frequently Asked Questions

Still have a question?

Speak with our legal team about your matter with clarity and confidence.

If the flat stands on CIDCO leasehold land, CIDCO must record the transfer to the buyer and charges a transfer fee. The sale itself is registered with the sub-registrar, but the buyer's title is not complete in CIDCO's books until the transfer is approved. If the plot has been converted to freehold, CIDCO's transfer fee no longer applies.

Since July 2025, CIDCO has offered optional conversion of leasehold residential plots to freehold where a lease deed has been executed, on payment of a one-time charge. After conversion, later transfers no longer attract CIDCO transfer fees. For a society building, the society usually applies, since the lease stands in its name.

On leasehold land, the lease usually bars mortgaging the property without CIDCO's consent, so many banks will not release a home loan until CIDCO grants permission to mortgage. The buyer applies after the agreement for sale is registered, and the loan is disbursed once the permission arrives.

Complaints about delayed possession, refunds or defects in a registered project go to MahaRERA, the Maharashtra Real Estate Regulatory Authority, and are filed online. Under Section 18 of the RERA Act you can claim a refund with interest or interest for each month of delay. The district consumer commission is an alternative in some cases.

Only for a valid reason under its bye-laws and the Maharashtra Co-operative Societies Act, such as incomplete forms or unpaid dues it is entitled to collect. An unreasonable refusal can be challenged before the Deputy Registrar or, for a dispute between a member and the society, the Co-operative Court.

We search the registered records for at least thirty years, or to the original CIDCO allotment if that is more recent. On top of the registry search, we check CIDCO's transfer record, the society file, court cases and bank charges, because a clean registry search alone does not show an untransferred CIDCO sale.

The CIDCO rules are the same, but the offices differ. Kharghar is in Panvel taluka of Raigad district, so property tax is billed by the Panvel Municipal Corporation and title disputes go to the civil courts at Panvel. Vashi is in Thane district under the Navi Mumbai Municipal Corporation, with civil cases at CBD Belapur.

Yes. Send scans of the agreements, CIDCO letters, share certificate and tax bill by email, and we review them and discuss the findings by phone or video. If you are close by, our Sanpada office is open by appointment, Monday to Saturday from 9 AM to 6 PM, and we can read the originals.
