- Divorce, maintenance and custody cases from Nerul are heard by the family court at CBD Belapur, not by the courts in Mumbai.
- Section 19 of the Hindu Marriage Act may also let you file where you married or where your spouse now lives, so compare the options before filing.
- A mutual consent divorce usually takes seven to nine months, or two to three months if the six-month wait is waived.
- Much of Nerul stands on land leased by CIDCO, so moving a flat in the settlement can need more than a registered deed.
- You can meet us at our Sanpada office, a short trip from Nerul, or consult by phone, WhatsApp or video.

Which court hears a divorce from Nerul?
The family court at CBD Belapur. Nerul, including Seawoods, is part of Navi Mumbai, and under Sections 7 and 8 of the Family Courts Act, 1984, divorce, maintenance and custody cases for the area go to that family court rather than to an ordinary civil court.
Belapur is not always the only choice. Section 19 of the Hindu Marriage Act opens other courts too: the place of the wedding, the town your spouse lives in today, the town of your last shared home, and, for a wife who files, her own town. So a wife in Nerul whose husband has moved to Andheri can file at Belapur, where she lives, or at the Family Court in Bandra, where he lives. If you married in Kolhapur, the court there is open too.
Maintenance under Section 144 of the Bharatiya Nagarik Suraksha Sanhita (earlier Section 125 CrPC) is also heard at Belapur, because Section 7(2) of the Family Courts Act gives the family court the magistrate's powers over maintenance. A Domestic Violence Act application usually goes to the magistrate, although Section 26 of that Act lets the family court make those orders within a pending divorce.
Can I file at Belapur if we married outside Navi Mumbai?
Yes, if you are the wife and now live in Nerul, if your spouse lives in Navi Mumbai, or if your last home together was here. The place of the wedding is one option, not a lock. A husband in Nerul whose wife has gone back to Pune, and who never lived with her in Navi Mumbai, would usually have to file in Pune or where they married.
Meet us in Sanpada, close to Nerul
Our office is Office 219, Haware Intelligentia Park, Plot No. 33, Sector-24, Sanpada-Turbhe Road, Navi Mumbai 400783. From Nerul it is a short drive, or a few minutes on the Harbour line towards Vashi. We see clients by appointment from Monday to Saturday, 9 AM to 6 PM.
Some clients from Nerul would rather not be seen walking into a lawyer's office close to home. In a neighbourhood where people know each other, that is a fair worry. The first consultation works just as well by phone, WhatsApp or video, with papers sent by email.
Your matter is led by Adv. Swanand Pandit (BLS, LL.B, LL.M, PGDBM, JAIIB), Advocate, High Court of Bombay. Adv. Ashok Ingle (B.A. LL.B) drafts the filings and updates you after each date. Phone +91 8291849797 or +91 9167710454, or email info@vivs.in.
Mutual consent divorce in Navi Mumbai, step by step
Where both of you accept that the marriage is over and can agree terms, this is the shorter road. The joint petition is filed under Section 13B of the Hindu Marriage Act, 1955, or Section 28 of the Special Marriage Act, 1954 for a registered civil marriage, after a year or more of separation.
- Write down the terms. The alimony and when each instalment is paid, stridhan and jewellery, where the children will live and when the other parent sees them, the flat and its loan, and which other cases are withdrawn.
- File the joint petition at Belapur. Both spouses sign it, with supporting affidavits, the marriage certificate, photographs and address proofs.
- Counselling. Section 9 of the Family Courts Act requires an attempt at settlement, so the court's counsellor meets you first. It is a conversation, not a test.
- First motion. The judge records each spouse's statement that consent is free and the terms are agreed.
- The wait, or a waiver. The second motion can be made six months after filing and no later than eighteen months. If your separation had already run eighteen months when the first motion was recorded and nothing is left to settle, you can ask the court to waive the wait under Amardeep Singh v. Harveen Kaur (2017).
- Second motion and decree. You both repeat your consent, the judge confirms that the agreed money has changed hands, and the decree is passed.
Either spouse can withdraw consent until the decree is passed. So plan the money and the flat so that each side completes its part at the second motion, not months before it.
Contested divorce in Navi Mumbai: when your spouse will not agree
One spouse files under Section 13 of the Hindu Marriage Act and has to prove a ground, commonly cruelty, or desertion lasting at least two years. After notice, the Belapur court sends both of you to counselling and usually to mediation. If that fails, the respondent files a written statement, the court frames the points in dispute, each side gives evidence by affidavit and faces cross-examination, and then the lawyers argue.
Money is dealt with early. Interim maintenance can be sought under Section 24 of the Hindu Marriage Act, or Section 144 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (earlier Section 125 CrPC), while the divorce proceeds. Under Rajnesh v. Neha (2020) both spouses must swear a statement of income, assets and liabilities, so pay slips, tax returns and bank statements are needed from the start.
Under Section 13 of the Family Courts Act a lawyer appears only with the court's permission. It is routinely given, but you still attend counselling and the dates when your own evidence is recorded. Plenty of contested cases settle in mediation and end as a mutual consent petition.
What happens to a Nerul flat in a divorce settlement?
A divorce decree does not move ownership. The flat stays in the name it is in until a deed is registered or a court orders otherwise, so the consent terms have to spell out exactly what happens to it and by when.
Nerul has a Navi Mumbai twist. CIDCO developed much of the node on land it leases out rather than sells, and many housing societies stand on CIDCO leases. Before the terms fix a date for transferring a flat, or one spouse's share in it, check whether your building needs CIDCO's permission or transfer charges, and what papers the society will want for its own records. A transfer that is agreed on paper but waiting for a lease-side approval can hold up the second motion.
A joint home loan needs separate attention, since the lender has to consent before one co-borrower can come off the loan. When we draft the consent terms, we time the release or transfer deed so that it is registered alongside the second motion. Our divorce lawyer page for Mumbai explains how a flat is treated in the four situations that come up most often.
How long does a divorce at the Belapur family court take?
| Route | Usual time from filing | What moves it |
|---|---|---|
| Mutual consent, wait waived | About two to three months | Eighteen months apart before the first motion, and every term settled. |
| Mutual consent, no waiver | Usually seven to nine months | The six-month gap and the court's dates. |
| Contested divorce | Usually two to four years | Mediation, interim applications, the number of witnesses and the court's list. |
Most delay comes from three places: papers missing at filing, a spouse who cannot be served because the address is old, and the court's own list. The first two are in your hands. Give your advocate a current address for your spouse, with something that proves it, before the petition goes in.
What to bring to the first meeting
- Your marriage certificate; if the marriage was registered in Navi Mumbai, a copy can be had from the Navi Mumbai Municipal Corporation
- For an unregistered marriage, wedding photographs and the invitation card
- Address proof for you, and the latest address you have for your spouse
- Pay slips, Form 16 or tax returns, and recent bank statements
- Flat papers: the agreement, the society share certificate, any CIDCO allotment or transfer letters, and loan statements
- A list of jewellery and other stridhan, and who holds each item now
- Children's birth certificates and school papers
- Any notice, police complaint or court paper you have already received
Copies are enough for the first meeting. The originals are needed when the petition is filed and statements are recorded.
Is a divorce lawyer based in Nerul itself better for your case?
Not because of the address. Divorces from Nerul are heard at Belapur whoever files them, so what matters is whether the advocate handles family cases there regularly, who will actually attend each date, and whether you get the fee in writing, stage by stage. A lawyer in the next node who does family work every week can serve you better than one down the road who rarely does.
Ask three things at the first meeting: which court your case belongs in and why, whether mutual consent is realistic on your facts, and what each stage will cost. Straight answers to those tell you more than any listing site.
What to do next
Gather the papers above, note the dates of the wedding and of the separation, and call us to fix a time in Sanpada or a video call. If there is violence at home, protection comes first: the police, or an application to the magistrate under the Domestic Violence Act, before any discussion of divorce.
For the Belapur court across every node, read our guide to divorce in Navi Mumbai. There are separate notes for Vashi and Kharghar.
