Meet a divorce lawyer in Navi Mumbai at our Sanpada office

VIVS Legal is a divorce lawyer in Navi Mumbai in the plainest sense: our only office is here, at Office 219, Haware Intelligentia Park, Plot No. 33, Sector-24, Sanpada-Turbhe Road, Navi Mumbai 400783. The Family Court at CBD Belapur, where most Navi Mumbai divorces are heard, is a few stations down the Harbour line.

That matters more than it sounds. A divorce runs over many dates, and a lawyer who works from the same city as the court can see you before a hearing, collect a signed affidavit the same afternoon and sit with you when the consent terms are finalised. Clients from Vashi, Nerul and Seawoods usually reach us in a few minutes; from Airoli, Ghansoli or Kopar Khairane it is a short drive via Turbhe; from Kharghar, Kamothe or Panvel it is a straight run along the Sion-Panvel Highway.

We see clients by appointment, Monday to Saturday, 9 AM to 6 PM. If being seen at a lawyer's office close to home is awkward, and in a sector where neighbours know each other it often is, the first consultation works just as well by phone, WhatsApp or video, with papers sent to info@vivs.in.

Your case is led by Adv. Swanand Pandit (BLS, LL.B, LL.M, PGDBM, JAIIB), Advocate, High Court of Bombay. Adv. Ashok Ingle (B.A. LL.B) prepares the filings and tells you what happened after each date. We have practised family law since 2010.

Divorce and family cases we handle in Navi Mumbai

We act in every kind of matrimonial case that reaches the Belapur family court, and in the criminal and magistrate cases that often run beside it.

  • Mutual consent divorce under Section 13B of the Hindu Marriage Act, 1955 or Section 28 of the Special Marriage Act, 1954, including the consent terms and an application to waive the six-month wait.
  • Contested divorce on cruelty, desertion or another ground under Section 13, whether you are filing or answering a petition.
  • Maintenance for a wife, children or parents under Section 144 of the Bharatiya Nagarik Suraksha Sanhita, 2023, and interim maintenance and litigation costs under Section 24 of the Hindu Marriage Act.
  • Custody and visitation, including interim arrangements while the divorce is pending and changes after the decree.
  • Domestic violence applications under the Protection of Women from Domestic Violence Act, 2005, for residence, protection and monetary orders.
  • Stridhan and the shared home, including what happens to a flat on CIDCO land and its home loan.
  • Divorces with a spouse abroad, where one side signs papers overseas and appears by video if the court allows it. Our NRI divorce lawyer page covers that route in detail.

Muslim, Christian and Parsi marriages follow their own statutes, and we advise on those too. The court and the overall shape of the case are similar; the grounds and some of the steps are not.

Which court hears a divorce from your node?

For most of Navi Mumbai, it is the Family Court at CBD Belapur, which has heard the area's matrimonial cases since late 2023, when it took them over from the Family Court at Thane. The catch is that Navi Mumbai is a planned city, not a district. It spreads across Thane and Raigad districts, and courts follow district lines.

NodesDistrict and civic bodyFamily court for a petition based on that address

Ulwe, DronagiriRaigad district (Panvel and Uran talukas)Not automatically Belapur: we confirm the court before drafting

Your own address is only one link. Section 19 of the Hindu Marriage Act lets a petition be filed where the marriage took place, where the respondent lives now, where the couple last lived together, or, if the wife files, where she lives now. A couple who last lived together in Nerul can file at Belapur even if one of them has since moved to Kharghar or out of Navi Mumbai altogether.

A petition filed in a court that lacks jurisdiction is returned, and the weeks lost do not come back. That is why we check the court before a single page is drafted. For the full node-by-node explanation, read our guide to the Belapur family court process.

Vashi, Nerul, Kharghar and Panvel: what changes by area

The law is the same across Navi Mumbai. What changes from one node to the next is the court, the civic body behind the flat and, quite often, how the separation has played out.

Vashi, Sanpada, Turbhe and Juinagar

These nodes sit in Thane district under the Navi Mumbai Municipal Corporation, so Belapur is the natural court. Many homes here are older CIDCO tenements and society flats, and an earlier sale that was never transferred in CIDCO's books is a common snag when a flat forms part of a settlement.

Nerul, Seawoods and CBD Belapur

Also Belapur. Couples here often married elsewhere, in Pune, Kolhapur or another state. That does not stop them filing at Belapur if they last lived together in Navi Mumbai or if the wife now lives here and is the one filing.

Airoli, Ghansoli and Kopar Khairane

Belapur again, though some clients from the northern nodes find the Thane court easier to reach. Whether Thane is open to you depends on the Section 19 links, not on convenience alone.

Kharghar, Kamothe, Kalamboli and Panvel

These fall in Raigad district. Belapur is often still available through the last shared home or the respondent's address, but it has to be checked. Kharghar flats also carry their own paperwork: property tax is billed by the Panvel Municipal Corporation, and a transfer between spouses needs CIDCO's permission as well as a registered deed.

A mutual consent divorce at Belapur usually takes seven to nine months from filing, or around two to three months when the court waives the six-month wait. Two conditions come first: at least a year since the wedding, and at least a year of living separately when the petition is presented.

  1. Agree the consent terms. Alimony and its instalment dates, stridhan, custody and visiting time, the flat and its loan, and every other case that will be withdrawn.
  2. File the joint petition. One petition signed by both spouses, an affidavit from each, and the terms annexed.
  3. Counselling. Section 9 of the Family Courts Act, 1984 requires the court to attempt a settlement first, so a counsellor meets you, together and often separately.
  4. First motion. The judge records that each of you consents freely.
  5. Wait or waive. The second motion falls six to eighteen months after filing. If you had already lived apart for eighteen months by the first motion and mediation has failed, a waiver can be sought under Amardeep Singh v Harveen Kaur (2017).
  6. Second motion and decree. Both of you confirm consent, the court checks the agreed payments, and the decree is passed.

Consent can be withdrawn until the decree, so we time the final alimony payment and any flat transfer to complete on the day of the second motion rather than months before it.

When your spouse will not agree

A contested divorce in Navi Mumbai means one spouse files under Section 13 of the Hindu Marriage Act and has to prove a ground, most often cruelty, or desertion for two years or more. These cases commonly take two to four years at Belapur, depending on how hard each issue is fought.

The court sends both sides to counselling and usually to mediation before written statements and evidence. Money and children are dealt with long before the decree. Interim maintenance and litigation costs under Section 24, maintenance under Section 144 BNSS and interim custody are applied for early. Since Rajnesh v Neha (2020), both spouses file a sworn affidavit of income, assets and liabilities, so a party who hides a salary or a second flat tends to be found out.

Where there is violence, a Domestic Violence Act application can run alongside. Under Section 26 of that Act, the family court can make the same protection and residence orders within the divorce itself. If a criminal complaint of cruelty under Sections 85 and 86 of the Bharatiya Nyaya Sanhita, 2023 has already been registered, it does not end with the divorce. A settlement should spell out how and when it will be quashed through the High Court.

Many contested cases end at mediation, with the couple switching to mutual consent once the money and the flat are settled. We prepare you for that conversation as carefully as for a trial.

The flat on CIDCO land in a divorce settlement

In Navi Mumbai the family home is often the largest asset in the divorce, and much of it sits on land CIDCO leased rather than sold. That changes how a share can pass from one spouse to the other.

  • Transfer permission. Moving a spouse's share needs CIDCO to record the change, alongside a registered deed and the housing society's transfer of the share certificate.
  • Transfer charges. CIDCO levies a transfer fee on leasehold property. The consent terms should say who pays it, and by when the transfer is completed.
  • Freehold conversion. Since July 2025, CIDCO has run an optional scheme to convert leasehold residential plots to freehold where a lease deed has been executed. Once converted, CIDCO no longer charges transfer fees on later transfers. Whether the plot under your building has been converted is worth checking before the settlement is signed.
  • The home loan. The bank is not bound by your consent terms. If one spouse keeps the flat, the loan has to be refinanced or the bank must agree to release the other borrower.

Our property lawyers in Navi Mumbai handle the CIDCO and society side of the transfer, so the settlement and the paperwork match.

What a divorce lawyer in Navi Mumbai costs

The fee for a divorce in Navi Mumbai depends far more on how much is disputed than on the type of divorce. An agreed divorce where the terms are already settled costs a fraction of a contested case with maintenance, custody and a domestic violence application all running at once.

What moves the cost:

  • whether the terms are agreed before filing, or have to be negotiated first;
  • how many proceedings run in parallel, for example maintenance, custody or a criminal complaint;
  • whether the flat or other property has to be valued, divided or transferred;
  • whether a spouse is abroad and papers have to be signed and attested overseas;
  • the number of hearings, which in a contested case is not in anyone's control.

We quote in writing after the first consultation, stage by stage, and say what is included and what is extra, such as court fees, stamp paper, certified copies and any CIDCO or registration charges. If the case changes, for example a mutual consent case turns contested, we tell you before the fee does. Read more on how to find a divorce lawyer in India.

How to choose a divorce lawyer in Navi Mumbai

Choose a lawyer who regularly appears at Belapur, explains the court and the next step in plain words, and puts the fee in writing. A good first meeting should leave you knowing which court you can file in, whether mutual consent is realistic, what to ask for in the meantime and roughly what it will cost.

Things to check before you hire anyone:

  • A named advocate. You should know who is responsible for your file and who will attend the dates.
  • Drafts before filing. You see the petition and the consent terms before they go to court.
  • Updates after every date. What happened, what the next date is and what you need to do.
  • Straight advice on settlement. A lawyer who never raises mediation, even when both sides want out, is not serving you.
  • No shortcuts. Anyone who suggests hiding income or assets puts your case at risk, because the affidavit of disclosure is sworn.

You can change your advocate at any stage by filing a change of advocate with the court. Our divorce lawyer services across India page explains how we work on cases outside Navi Mumbai.

Papers to bring to Sanpada

Bring copies to the first meeting. Originals are needed only when the petition is filed and on the motion days.

  • Marriage certificate, or the wedding invitation and photographs if the marriage was never registered.
  • Address proof for each spouse that shows the node, because the address decides the court.
  • Proof of the date you separated, such as a rent agreement for the second home or dated messages.
  • Salary slips, Form 16 or income tax returns, and bank statements.
  • Flat papers: the agreement, share certificate, CIDCO lease or transfer letters and loan statements.
  • Children's birth certificates and school records.
  • Copies of any FIR, Domestic Violence Act application or maintenance case already filed.

A one-page timeline of the marriage and the separation, with your main goals in order, makes the first meeting far more useful.

FAQ

Frequently Asked Questions

Still have a question?

Speak with our legal team about your matter with clarity and confidence.

Often, yes. Kharghar and Kamothe are in Raigad district, so your own address does not automatically point to Belapur. But Section 19 of the Hindu Marriage Act also allows the court where the couple last lived together or where the respondent lives. If either of those is in the Belapur court's area, you can usually file there.

Yes. Our office is in Sector-24, Sanpada, a few minutes from Vashi and Nerul by road or on the Harbour line. We meet clients by appointment, Monday to Saturday from 9 AM to 6 PM. If an office visit is awkward, the first consultation can be done by phone, WhatsApp or video instead.

Usually seven to nine months from filing, because the second motion cannot be heard until six months after the petition. If you had lived apart for eighteen months by the first motion and mediation has failed, the court can waive the wait, and the case may finish in about two to three months.

Fees depend mainly on how much is disputed. An agreed divorce with settled terms costs much less than a contested case with maintenance, custody or a domestic violence application alongside. We quote in writing, stage by stage, after the first meeting, and list what is extra, such as court fees, certified copies and any CIDCO transfer charges.

Yes, consent is personal, so both spouses appear for the motions, in person or by video where the court allows it for a spouse who lives far away or abroad. A Power of Attorney holder can sign papers for an absent spouse but cannot give consent in court on their behalf.

The consent terms decide who keeps it, who pays the loan and by when the share is transferred. On CIDCO leasehold land, the transfer needs a registered deed, CIDCO recording the change, and the society moving the share certificate. If the plot has been converted to freehold, CIDCO transfer charges no longer apply.

Yes. Interim maintenance and litigation costs can be sought under Section 24 of the Hindu Marriage Act while the divorce is pending, and maintenance under Section 144 of the Bharatiya Nagarik Suraksha Sanhita can be claimed even without a divorce. Both spouses file sworn affidavits of income and assets.

Yes, if another Section 19 link points to Navi Mumbai. The place of the wedding is only one option. You can also file where you last lived together, where the respondent lives now, or, if the wife is filing, where she lives now. Many Belapur cases involve couples married outside Maharashtra.

Family court hearings are not open like ordinary civil trials, and counselling sessions are private. Your file stays with us. If you prefer not to be seen visiting a lawyer close to home, we can handle the first consultation and most updates by phone, WhatsApp, email or video.
