Delhi courts, from abroad

NRI divorce lawyer in Delhi for spouses living abroad

Need an NRI divorce lawyer in Delhi? VIVS Legal handles mutual consent and contested divorces in Delhi's family courts for spouses living overseas, along with maintenance claims, custody and related criminal complaints. We work online from Sanpada, Navi Mumbai, using video calls, email and a Power of Attorney.

Delhi has family courts in six district court complexes, and the right one depends on where you married, where your spouse lives or where you last lived together. We draft every paper ourselves; appearances in Delhi are covered by a local advocate we instruct, and the cost of that is agreed at the first consultation.

What an NRI divorce lawyer in Delhi does for you

An NRI divorce lawyer in Delhi runs the Indian side of a divorce for a spouse who lives abroad when the marriage, the other spouse or the family home is in Delhi. That covers filing or defending the petition in a Delhi family court, the maintenance and custody claims that come with it, and any criminal complaint filed alongside. VIVS Legal handles this online from Sanpada, Navi Mumbai.

We do not have an office in Delhi, and we say so at the start. We draft every petition, reply, affidavit and settlement ourselves, and we prepare your Power of Attorney and your evidence. Appearances at the Delhi court complex are covered by a Delhi advocate we instruct and supervise. Who that is and what it adds to the fee is settled at the first consultation, before you pay for any filing.

Clients usually come to us at one of these points:

  • Nothing is filed yet. You want a mutual consent divorce and need to know where to file and whether you must fly in.
  • Your spouse has filed in Delhi. A notice has reached you abroad, or a relative has received it at the family address, and a date is running.
  • You already hold a foreign decree. You need to know whether India will accept it before you remarry or sell a jointly owned flat in Dwarka or Noida.
  • A complaint has been filed. A cruelty or dowry complaint names you and your parents, and you need advice before you travel.

If you and your spouse both live in Delhi, our divorce lawyer in Delhi page for residents is the better place to start. The rest of this page is written for the spouse who is overseas.

Can you file for divorce in Delhi while living abroad?

Yes. Living abroad does not take away your right to file in India, and Delhi is open to you if one of the grounds in Section 19 of the Hindu Marriage Act, 1955 points there. The petition can go to the family court for the area where:

  1. the marriage was solemnised, for example at a gurdwara in Rajouri Garden or a banquet hall in Chhattarpur;
  2. your spouse lives when the petition is filed;
  3. you and your spouse last lived together;
  4. the wife lives, if she is the one filing;
  5. you live, if your spouse is outside India at the time of filing.

The last ground matters for many NRI couples. If you have moved back to Delhi and your spouse is still in Toronto or Dubai, you can file where you live now. If you are the one abroad, you will usually rely on the place of marriage, your spouse's home or the last shared home.

Couples married under the Special Marriage Act, 1954, including many inter-faith and court marriages registered in Delhi, follow a similar set of forums under Section 31 of that Act. Our note on whether an NRI can file for divorce in India covers the general rule in more detail.

Which Delhi family court will hear your case?

Delhi's family courts sit in six of its district court complexes, and each complex covers particular districts. The address that gives the court jurisdiction decides which complex you file in. It is worth getting right, because a petition in the wrong court is returned and the time is lost.

Court complexDistricts it coversTypical NRI link
SaketSouth, South-EastMarriage in South Delhi; parents' home in Hauz Khas, Kalkaji or Lajpat Nagar
Patiala HouseNew DelhiMarriage or last home in central New Delhi
Tis HazariCentral, WestFamily home in Karol Bagh, Rajouri Garden or Janakpuri
RohiniNorth, North-WestSpouse living in Rohini or Pitampura
DwarkaSouth-WestFlat in Dwarka or Najafgarh that the couple last shared
KarkardoomaEast, North-East, ShahdaraSpouse's family in Preet Vihar, Mayur Vihar or Shahdara

District lines follow police station areas, not neighbourhood names, so we confirm the court from the exact address before drafting. Gurugram, Noida, Ghaziabad and Faridabad are outside Delhi and have their own family courts in Haryana and Uttar Pradesh. A couple who last lived together in Gurugram cannot use Delhi on that ground alone.

Appeals from a Delhi family court go to the Delhi High Court under Section 19 of the Family Courts Act, 1984.

A mutual consent divorce under Section 13B of the Hindu Marriage Act is usually the fastest route, and it can be done with very little travel. Both spouses must have lived separately for at least a year and agree on every term. Here is how it normally runs when one of you is overseas:

  1. Settle the terms in writing. Permanent alimony and how it is paid, stridhan and jewellery, custody and video access, the Delhi flat and its home loan, and the withdrawal of any pending cases or complaints.
  2. Sign the petition and a Power of Attorney abroad. You sign before an Indian mission, or before a notary with an apostille where your country is in the Hague Convention. Our page on Power of Attorney for NRIs explains both routes.
  3. File and attend the first motion. The petition is filed in the right Delhi family court. The court sends you to its mediation centre for a short session and then records both statements. Your statement is recorded by video where the judge allows it.
  4. The waiting period, or a waiver. The second motion comes between six and eighteen months after the petition is presented. Under Amardeep Singh v. Harveen Kaur (2017), the court can waive the six months if you had already lived apart for eighteen months before the first motion, mediation has failed and every term is settled.
  5. Second motion and decree. Both spouses confirm consent again, the court checks the payments and passes the decree. We send you a certified copy for use abroad.

Delhi's courts do hold hearings by video, but a family court decides for itself whether it will record a consent statement that way. Some judges want each spouse in person once. We find out what your court expects before you book or cancel a flight.

When your spouse files in Delhi and you are abroad

Do not ignore the summons. If you do not appear, a Delhi family court can hear the case ex parte and pass a decree, or an order for maintenance, without your side being put. Setting that aside later is slow and not guaranteed.

What we do once you send us the papers:

  • Check jurisdiction first. If none of the Section 19 grounds point to that court, we raise it in the written statement before anything else.
  • File your reply and disclosure. Since the Supreme Court's decision in Rajnesh v. Neha (2020), both spouses file a sworn affidavit of assets and liabilities in any maintenance claim. Your foreign salary, savings and liabilities go into it, and an accurate affidavit protects you more than a vague one.
  • Answer maintenance claims together. Interim maintenance under Section 24 of the Hindu Marriage Act, maintenance under Section 144 of the Bharatiya Nagarik Suraksha Sanhita, 2023, and relief under the Protection of Women from Domestic Violence Act, 2005 are often filed in parallel. We ask the courts to take earlier orders into account so you are not paying twice.
  • Look for settlement early. Many contested Delhi cases end as mutual consent once both sides see the figures. The court mediation centre is often where that happens.

Your own evidence is the one thing an attorney cannot give for you. The Supreme Court held in Janki Vashdeo Bhojwani v. IndusInd Bank (2005) that a Power of Attorney holder can only speak to what he or she personally knows. In a contested trial, expect to give evidence yourself, by affidavit and cross-examination, by video if the court permits it or during a planned visit.

Criminal complaints, anticipatory bail and travel

In many Delhi matrimonial disputes, a complaint of cruelty under Section 85 of the Bharatiya Nyaya Sanhita, 2023 (formerly Section 498A of the IPC) or under the Dowry Prohibition Act, 1961 is filed alongside the divorce. Delhi Police usually route such complaints first to the Crime Against Women Cell for counselling and an attempt at settlement.

If you are named and live abroad, plan before you fly:

  • We find out whether a case has been registered, at which police station, and under which sections.
  • Where arrest is a real risk, we apply for anticipatory bail under Section 482 of the Bharatiya Nagarik Suraksha Sanhita before you travel. The arrest safeguards set out in Arnesh Kumar v. State of Bihar (2014) still guide the police and the courts.
  • Where parents or siblings in Delhi are also named, their bail is usually handled in the same application.

A settlement in the divorce often includes withdrawing or quashing these complaints. Quashing a cruelty case on settlement is done by petition to the Delhi High Court, and we draft the terms so that step follows cleanly once the decree is passed.

Will a foreign divorce decree be accepted in Delhi?

Sometimes. India tests a foreign divorce against Section 13 of the Code of Civil Procedure, 1908 and the Supreme Court's ruling in Y. Narasimha Rao v. Y. Venkata Lakshmi (1991). A foreign decree usually holds where it was granted on a ground Indian law recognises and your spouse took part in the case or consented to it. A decree granted on grounds Indian law does not accept, or one your spouse never joined, is open to challenge.

This matters when you want to remarry in India, sell a jointly held Delhi flat, or deal with a pension or inheritance. Where the foreign decree is doubtful, the safer course is a fresh petition in Delhi, or mutual consent proceedings here, so the Indian record is clear. Our complete guide to NRI divorce in India covers recognition country by country, and our pages for clients in the USA, UK and Canada deal with the questions particular to each.

Documents an NRI should send before the first call

You do not need originals for the first consultation. Scans of these let us give a firm view on court, route and cost:

  • Marriage certificate, or wedding photographs and the card if the marriage was never registered.
  • Both spouses' addresses in Delhi and abroad, with the date you last lived together and where.
  • Passport pages and visa or residence permit, which show where you live and for how long.
  • Any petition, summons, legal notice or police notice already received.
  • Salary slips or tax returns, and papers for any Delhi flat or home loan.
  • Children's birth certificates and school details, if custody is in question.

FAQ

Frequently Asked Questions

Still have a question?

Speak with our legal team about your matter with clarity and confidence.

Yes, if a ground under Section 19 of the Hindu Marriage Act points to Delhi: the marriage took place there, your spouse lives there, or you last lived together there. You sign the petition and a Power of Attorney in the US, and your statements are recorded by video where the court allows.

It depends on the address that gives Delhi jurisdiction. Delhi's family courts sit at Saket, Patiala House, Tis Hazari, Rohini, Dwarka and Karkardooma, each covering certain districts. District lines follow police station areas, so we confirm the court from the exact address before drafting the petition.

Often not. Your consent statements at the first and second motion can usually be recorded by video if the family court agrees, and a Power of Attorney holder handles filing. Some Delhi judges want each spouse in person once, so we check your court's practice before you plan travel.

Respond before the date in the summons. If you stay away, the court can proceed ex parte. We check whether the Delhi court has jurisdiction, file your written statement and asset affidavit, and look for a settlement at the same time, since many contested cases end by consent.

A mutual consent divorce usually takes seven to nine months, or two to three if the court waives the six-month wait. A contested divorce commonly takes two to four years in Delhi, longer if maintenance, custody and criminal complaints are fought separately.

Only if it meets Section 13 of the Code of Civil Procedure and the test in Narasimha Rao (1991). A decree on a ground Indian law recognises, where your spouse took part or consented, usually holds. Otherwise, a fresh petition or mutual consent divorce in Delhi gives a safer record.

Yes. A Delhi court can order interim and final maintenance based on your income abroad, and both spouses must file a sworn affidavit of assets and liabilities under Rajnesh v. Neha (2020). An order is most easily enforced against bank accounts or property you hold in India.

We draft every paper ourselves from our Navi Mumbai office and instruct a Delhi advocate for hearings at the Delhi court complex. You are told who that is and what the appearance fee will be at the first consultation, before anything is filed.

Yes, an application for anticipatory bail under Section 482 of the Bharatiya Nagarik Suraksha Sanhita can be filed while you are abroad, usually before you travel. We first find out whether a case is registered and under which sections, then apply in the right Delhi court.
