NRI divorce lawyer in Navi Mumbai for cases at the CBD Belapur Family Court
An NRI divorce lawyer in Navi Mumbai handles the Indian side of your divorce when you live abroad and your spouse, your parents, your children or the CIDCO flat are in Vashi, Nerul, Kharghar, Airoli or another node. Those cases go to the Family Court at CBD Belapur, and our only office is in Sanpada, a short drive from it.
That makes the practical side simpler. Your parents or a sibling can meet us in person, act as your attorney, bring original papers and collect the decree, while you take part by video and email from wherever you live.

Why Navi Mumbai is different for NRI clients
An NRI divorce with its Indian roots in Navi Mumbai is heard at one court, the Family Court at CBD Belapur, and our only office is in Sanpada, a short drive away. That puts your family, your advocate and the court within the same few kilometres, even when you are thousands of kilometres away.
It changes three practical things. Your parents or a sibling can meet us in person, sign as your attorney and hand over original papers. Hearing-day questions are answered across a desk, not by long-distance calls. And the CIDCO flat that often sits at the centre of the settlement has its own rules, explained below. These cases do not go to Bandra or Thane; Greater Mumbai cases are covered on our NRI divorce lawyer Mumbai page.
Can the Belapur Family Court hear your case from abroad?
Yes, if Navi Mumbai is where you married, where your spouse lives, where you last lived together, or where the wife lives if she is the one filing. When the respondent lives outside India, the petitioner can also file where the petitioner lives. These are the five doors in Section 19 of the Hindu Marriage Act, 1955.
| The facts | Belapur open? |
|---|---|
| Married at a hall in Vashi, both spouses now in Australia | Yes, as the place of marriage |
| Husband in Doha, wife back with her parents in Nerul and filing | Yes, on her residence |
| Wife in Toronto, husband living in the family flat in Kharghar | Yes, where the respondent lives |
| Couple lived in Airoli until the husband left for a job abroad alone | Yes, as the last shared home |
| Married in Mumbai city, both abroad, only the in-laws live in Sanpada | No: the in-laws' address does not count |
Marriages under the Special Marriage Act, 1954 follow the same pattern in Section 31. If no Indian court is open, the divorce may have to be taken abroad, and our page on whether an NRI can file for divorce in India explains how to check that first.
What your family in Navi Mumbai can do for you
A parent or sibling in Navi Mumbai, holding your Power of Attorney, can carry most of the case: give us instructions on the day, attend routine dates with your advocate, receive the other side's papers and collect the certified copy of the decree. What they cannot do is speak for you on facts only you know.
- They can sign applications for adjournment or for copies, pay court fees, verify originals at our office and courier documents to you.
- They can, if the court allows, stand in for you in a mutual consent case where you cannot attend for a good reason. Amardeep Singh v Harveen Kaur (2017) let family courts accept parents or siblings for this, and use video conferencing.
- They cannot give evidence in your place about the marriage itself. In Janki Vashdeo Bhojwani v IndusInd Bank (2005), the Supreme Court held that an attorney may depose only to what the attorney personally knows.
Choose someone who can reach Belapur at short notice, and give a Power of Attorney for this case only. A general one, kept for years, causes trouble later.
Signing papers abroad for a Belapur case
Every paper you sign abroad must reach Navi Mumbai in a form the court and the stamp office will accept. Get this right first, because a defective signature costs a hearing.
- Affidavits. Swear them before an Indian consular officer, who may administer oaths under the Diplomatic and Consular Officers (Oaths and Fees) Act, 1948, or before a local notary followed by an apostille.
- Power of Attorney. The same two routes. India is a party to the Hague Apostille Convention; if the country you live in is not, sign at the Indian consulate instead.
- Stamping. A document signed outside Maharashtra must be stamped within three months of first arriving in the state, under Section 19 of the Maharashtra Stamp Act. Send the original to our Sanpada office and we handle it.
- Identity and address. A copy of your passport and visa or residence permit, and proof of your foreign address for the court record.
The wording and signing routes are explained step by step in our guide to the NRI Power of Attorney in India.
Mutual consent divorce at Belapur for an NRI couple
For a couple who can agree terms, a joint petition under Section 13B at the Belapur Family Court is the fastest way through. You need at least a year of living apart before filing, signed consent terms, and two recorded statements of consent with the statutory gap between them.
| Step | Spouse abroad | Family in Navi Mumbai | VIVS Legal |
|---|---|---|---|
| Terms | Agrees alimony, children and the flat by email and video | Gathers flat and society papers | Drafts the consent terms |
| Petition | Signs the petition and affidavit abroad | Brings originals to Sanpada | Files at Belapur |
| First motion | Consent recorded by video, if allowed | Attends as attorney | Appears and seeks leave |
| Six-month gap | Nothing, or supports the waiver | Nothing | Applies for a waiver under Amardeep Singh where the conditions are met |
| Second motion | Confirms consent again | Attends | Obtains the decree |
| After the decree | Receives the certified copy | Signs the flat transfer as attorney | Registers the deed and updates the society |
Expect seven to nine months without a waiver. Couples who both live in Navi Mumbai can read the resident process on our divorce lawyer in Navi Mumbai page.
The CIDCO flat and other Navi Mumbai property
Most Navi Mumbai housing stands on land that CIDCO leased to the society or developer, and that shapes how a flat changes hands in a divorce. Agreeing the transfer in the consent terms is only the start.
- Leasehold or freehold. On leasehold CIDCO land, a transfer has usually needed CIDCO's transfer permission and charges. The state has since approved optional conversion of CIDCO residential plots to freehold, so we first check whether your society's plot has converted and what that means for your transfer.
- Society and share certificate. The cooperative housing society must record the transfer and issue the share certificate in the new name.
- Stamp duty between spouses. A gift of a residential flat to a spouse carries concessional duty of ₹200 under Article 34 of the Maharashtra Stamp Act.
- CIDCO lottery flats. Allotment letters from CIDCO housing schemes can carry conditions on transfer. We read yours before the terms are signed, not after.
- Home loan. The bank's consent is needed before either borrower is released from a joint loan.
A wife who lived in the flat as a family home also has a right to reside there under Section 17 of the Domestic Violence Act, 2005, whoever owns it. The settlement should deal with that right expressly. For title checks on the flat, see our property lawyers in Navi Mumbai.
Maintenance, children and criminal complaints in Navi Mumbai
Divorce is often only one of several cases. These are the others an NRI with family in Navi Mumbai most often meets.
Maintenance
A wife can claim maintenance under Section 144 of the Bharatiya Nagarik Suraksha Sanhita, 2023, which in Navi Mumbai is heard by the family court at Belapur, and under the Domestic Violence Act. Since Rajnesh v Neha (2020), both sides file a sworn statement of assets and income. For the spouse abroad, that means foreign salary, overseas savings and property abroad, all disclosed.
Children
Custody and guardianship cases go to the court where the child ordinarily lives, under Section 9 of the Guardians and Wards Act, 1890. A child at school in Navi Mumbai means the case is heard here, with the child's welfare as the only test. If a child has been brought from abroad without consent, the remedy is usually a habeas corpus petition in the Bombay High Court.
Criminal complaints
A complaint of cruelty under Section 85 of the Bharatiya Nyaya Sanhita, 2023 is registered with the Navi Mumbai police. Before you travel to India while one is pending, seek anticipatory bail, and remember that a pending criminal case can affect your passport under Section 10(3)(e) of the Passports Act, 1967.
Foreign divorces and remarriage: settling it in Navi Mumbai
If you divorced abroad and the marriage was registered in Navi Mumbai, a registrar or a bank here may ask whether that decree is valid in India. The test comes from Y. Narasimha Rao v Y. Venkata Lakshmi (1991): the decree should rest on a ground known to the law you married under, and your spouse should have taken part or consented.
When there is doubt, there are two clean fixes. The Belapur Family Court can declare your marital status under Section 7 of the Family Courts Act, 1984. Or, if your former spouse agrees, a mutual consent divorce at Belapur ends the question. Our NRI divorce lawyer services page explains how decrees from different countries are treated, and the pages for Canada and Australia cover two of the most common.

Frequently Asked Questions
Still have a question?
Speak with our legal team about your matter with clarity and confidence.
Largely, yes. Holding your Power of Attorney, a parent can attend routine dates with your advocate, receive papers and collect the decree. In a mutual consent case the court may accept a parent for you if you cannot attend for a good reason. Your own evidence still has to come from you.
The Family Court at CBD Belapur, which hears divorce, maintenance and custody cases for the Navi Mumbai nodes. It is open to you if one of the Section 19 links points to Navi Mumbai: the marriage, your spouse's home, your last shared home, or the wife's present home.
Yes. Where the respondent lives is one of the grounds in Section 19 of the Hindu Marriage Act, so a husband abroad can file at Belapur against a wife living in Navi Mumbai. She can equally file there herself, on her own residence, if she is the one seeking divorce.
Yes. Under Section 19 of the Maharashtra Stamp Act, a document signed outside the state must be stamped within three months of first arriving in Maharashtra. Sign it at an Indian consulate or before a notary with an apostille, courier the original to our Sanpada office, and we arrange stamping.
Yes, by a registered deed after the terms are agreed. First check whether the plot is still CIDCO leasehold, which usually needs transfer permission, or has been converted to freehold. The society then issues a new share certificate. A gift to a spouse carries ₹200 stamp duty in Maharashtra.
Yes. Book a slot at our office in Sanpada, open Monday to Saturday from 9 AM to 6 PM. Bring your passport, the marriage certificate and any papers already served on you. We can often prepare and get everything signed in one sitting, so the case runs smoothly after you fly back.
One missed date with your advocate present rarely matters. If nobody appears for you, the court may proceed ex parte. An ex parte decree can be set aside under Order IX Rule 13 of the Civil Procedure Code if you show sufficient cause, but it is slow, so keep an attorney and advocate on record.
Usually not under the Guardians and Wards Act, which sends custody cases to the court where the child ordinarily lives. If the child lives abroad, the courts there will normally decide. If the child has recently been brought to Navi Mumbai, the Bombay High Court can hear a habeas corpus petition.
