NRI divorce lawyers in Hyderabad for couples living apart across countries
NRI divorce lawyers in Hyderabad deal with a divorce where one spouse lives abroad, often in the US or the Gulf, and the case belongs in a Hyderabad family court. VIVS Legal handles mutual consent and contested divorces, maintenance, custody and khula matters for these couples online from Sanpada, Navi Mumbai, using video calls and a Power of Attorney.
The right court depends on Section 19 of the Hindu Marriage Act and on whether the address falls in Hyderabad, Ranga Reddy or Medchal-Malkajgiri district. We draft every paper ourselves; hearings in Hyderabad are covered by a local advocate we instruct, and that cost is agreed at the first consultation.

How an NRI advocate in Hyderabad handles your divorce
An NRI advocate in Hyderabad deals with the divorce, maintenance and custody questions that arise when one spouse lives abroad and the case belongs in a Hyderabad family court. Most of the couples we hear from fall into one of two patterns: a spouse working in the US, often on an H-1B, with the other spouse back in Hyderabad, or a husband working in the Gulf while his wife and children live with family in the city.
VIVS Legal handles this work online from Sanpada, Navi Mumbai. We have no office in Hyderabad. We draft the petition, the reply, the maintenance affidavits and the settlement terms, prepare your Power of Attorney, and plan your evidence. Appearances in Hyderabad are covered by a local advocate we instruct and supervise, and the cost of that is agreed at the first consultation.
If both spouses live in Hyderabad, our divorce lawyers in Hyderabad page covers the city's courts and procedure for residents. This page is for the case with a spouse overseas.
Where can the case be filed when one spouse lives abroad?
Section 19 of the Hindu Marriage Act, 1955 decides which court can hear the petition. For NRI couples linked to Hyderabad, four grounds come up most:
- Where the wife lives, if she files. A wife who has returned to her parents' home in Hyderabad can file there even if the marriage took place elsewhere and the husband is abroad.
- Where the petitioner lives, if the other spouse is outside India. A husband or wife who has moved back to Hyderabad can file there when the other spouse is overseas.
- Where the marriage took place, for example a function hall in Hyderabad.
- Where the couple last lived together, which may be a flat in Gachibowli before the move abroad.
Within the city, the address decides between three sets of family courts. Old City, Abids, Banjara Hills, Jubilee Hills and Secunderabad come under the Hyderabad district family courts at the Integrated Family Courts complex, Purani Haveli. Much of the IT corridor, including Gachibowli, Madhapur and Kondapur, falls under the Ranga Reddy district family court, and Kukatpally, Malkajgiri and Medchal under Medchal-Malkajgiri. Appeals go to the Telangana High Court. We confirm the court from the exact address before drafting.
Muslim couples follow their personal law and the Dissolution of Muslim Marriages Act, 1939, Christian couples the Divorce Act, 1869, and civil marriages the Special Marriage Act, 1954, each with its own forum rules.
Mutual consent divorce with a spouse in the USA or the Gulf
A mutual consent divorce under Section 13B is usually possible without the spouse abroad flying in for every date. The steps:
- Agree the terms in writing. Alimony and how it is paid, stridhan and gold, custody and access by video, the Hyderabad flat or plot, and the withdrawal of any other case.
- The spouse abroad signs. The petition, an affidavit and a Power of Attorney are signed before an Indian mission, or before a notary with an apostille where that country is in the Hague Convention. See how an NRI Power of Attorney is signed abroad.
- File the joint petition in the family court that has jurisdiction.
- First motion. Both statements are recorded, the absent spouse by video where the court allows.
- Second motion and decree, after the six-month wait or after a waiver granted under Amardeep Singh v. Harveen Kaur (2017).
For a Muslim couple, a mubarat agreed in writing or a khula can end the marriage without a court petition, and a declaration from the family court under Section 7 of the Family Courts Act, 1984 settles the position if the record is later questioned, for example for a visa or remarriage abroad. Triple talaq is void and an offence under the Muslim Women (Protection of Rights on Marriage) Act, 2019.
Maintenance from a husband working abroad
A wife in Hyderabad has three routes, and they can run together:
- Interim maintenance and litigation costs under Section 24 of the Hindu Marriage Act while the divorce is pending.
- Maintenance for herself and the children under Section 144 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (earlier Section 125 of the CrPC), which does not depend on a divorce being filed.
- Monetary relief and a residence order under the Protection of Women from Domestic Violence Act, 2005.
Both spouses must file a sworn affidavit of assets and liabilities, a requirement laid down by the Supreme Court in Rajnesh v. Neha (2020). The husband's foreign salary, bonuses and savings go into it. Courts take one order into account when fixing another, so the same need is not paid for twice.
Whichever side you are on, the amount is argued from the actual figures. An H-1B salary in dollars and the cost of living in the US are both relevant, and a husband who understates income in his affidavit risks the court drawing an adverse inference.
How is an order enforced against a spouse abroad?
Most effectively against what the spouse holds in India. A Hyderabad family court can attach bank accounts, a flat or plot, rent received in India, or other assets here, and can issue recovery warrants for arrears. That is why we look at Indian assets at the very start of a maintenance case.
Enforcing an Indian order abroad is harder and depends on the law of that country. Section 44A of the Code of Civil Procedure works in the other direction: it lets Indian courts execute decrees from countries India has notified as reciprocating territories. The UAE has been one since January 2020 and the United States is not, and that reciprocity is part of why an Indian decree is more workable before a UAE court than an American one. For the same reason, a negotiated lump sum in a mutual consent settlement is often worth more to a wife than a monthly order she must chase across borders.
Our pages for couples in the USA, the UAE and Saudi Arabia explain the position for those countries in more detail.
What a Power of Attorney can and cannot do
A Power of Attorney lets a parent or sibling in Hyderabad file papers for you, attend routine dates, collect certified copies and receive notices. It saves most of the travel in an NRI divorce.
It cannot replace you on two things. Your consent to a mutual divorce must come from you, recorded by the court, by video where allowed. And in a contested case, your evidence must be your own: the Supreme Court held in Janki Vashdeo Bhojwani v. IndusInd Bank (2005) that an attorney holder can depose only to what he or she personally knows. We plan the case so your own appearances are few and fixed in advance.
When a foreign divorce reaches a Hyderabad court
A divorce granted in the US or elsewhere is tested in India under Section 13 of the Code of Civil Procedure and Y. Narasimha Rao v. Y. Venkata Lakshmi (1991). It usually stands where it was granted on a ground Indian law recognises and the other spouse took part or consented. A US decree obtained on a ground Indian law does not recognise, without the wife in Hyderabad taking part, is the weak case, and she may still pursue maintenance here.
If you hold such a decree and plan to remarry or sell property in India, take advice first. Often the cleanest step is a mutual consent divorce in Hyderabad, which leaves no doubt. Our NRI divorce guide sets out the recognition rules in full.

Yes. A wife living in Hyderabad can file there under Section 19 of the Hindu Marriage Act even if the husband is abroad and the marriage took place elsewhere. The case goes to the family court for her address: Purani Haveli, Ranga Reddy or Medchal-Malkajgiri, depending on where she lives.
Yes. You can claim interim maintenance under Section 24 of the Hindu Marriage Act, maintenance under Section 144 of the BNSS and relief under the Domestic Violence Act. His US salary counts, and both of you must file sworn asset affidavits. Orders are enforced most easily against his assets in India.
Usually not for every date. You sign the petition and a Power of Attorney abroad, and your consent is recorded by video where the family court allows it. Some judges ask each spouse to appear once in person, so we confirm the court's practice before you plan travel.
It depends on the address that gives jurisdiction. Hyderabad district cases go to the Integrated Family Courts at Purani Haveli; Gachibowli, Madhapur and Kondapur usually fall under Ranga Reddy; Kukatpally and Malkajgiri under Medchal-Malkajgiri. We confirm it from the exact address.
Yes, most reliably through his bank accounts, property or income in India, which the court can attach. An Indian decree can also be placed before a UAE court for execution, and the reciprocal arrangement between India and the UAE helps, though UAE procedure applies. A lump sum agreed in a settlement is often more dependable.
Not automatically. It is tested under Section 13 of the Code of Civil Procedure and Narasimha Rao (1991). It usually holds if granted on a ground Indian law accepts and the wife took part or consented. Otherwise, a fresh or mutual consent divorce in Hyderabad gives a clear record.
He can file papers, attend routine dates and collect orders under a Power of Attorney. He cannot give your consent statement or your evidence; under Janki Vashdeo Bhojwani (2005) an attorney can speak only to what he personally knows. Those parts come from you, by video where allowed.
By talaq in the recognised form, khula at the wife's request, mubarat by mutual agreement, or court dissolution under the 1939 Act. Triple talaq is void. A declaration from the family court under Section 7 of the Family Courts Act settles the status if a visa office or registrar questions it.
No. Our only office is in Sanpada, Navi Mumbai. We run Hyderabad NRI divorces online and draft every paper ourselves, and a Hyderabad advocate we instruct covers court appearances. You are told who that is and the appearance fee at the first consultation.
